Transferring title to points -- easiest way?

Here's our story: A brother and sister team went in on the purchase of two DVC contracts at SSR. Both of the contracts were initially purchased in the name of the brother because, when we bought, DVC could not yet sell SSR in California (the residence state of the sister). Now, however, both contracts are paid in full and we would like to transfer title of one contract into the name of the sister. Does anyone know the best way to handle this? I assume that one of the companies that handles DVC resales on a regular basis would be willing to help us effectuate transfer (for a fee + closing costs, of course). Does that sound right? Has anyone done a such a point transfer amongst family members before? Or something similar? If so, I would love to hear your thoughts. FYI, neither one of us live in Florida. If we did, this would be much simpler! Thanks!
 
Can't really help, but at least this will bump your post higher.

I do think you should call Member Accounting and ask them how to do this so you don't run into problems with Disney's ROFR.

I was worried about ROFR too. I think Disney better answer this one!
 
Thanks everyone. ROFR is not a problem. I already discussed that point with several folks at Member Services and with my guide. Totally okay to give your points to a family member as a gift. Happens all the time. In fact, I think I am already listed as an associate on the contract I am trying to transfer.
 

Well, it only makes sense. If you want to will your points to your children, for example, they shouldn't require that you go through ROFR. So why would it be different if you decide to gift the points instead during your lifetime? It's a totally different situation from a sale which has an impact on the market price of resales, etc.
 
I have a friend who wants to give me her points, but because she is not a realtive, we were told we couldn't do that.
 
I think you still have to go through ROFR but it's automatic in this situation. You should be able to easily transfer. You could easily do the deed yourself or even a quit claim deed and all you'd be out is the recording. I don't know if DVC will waive the transfer fees but I'd ask them in this situation.
 
Call Disney and ask how to execute a quit claim deed. They'll tell you to contact the county....essentially leading you in the right direction. You should be able to do this very cheaply, I've done them for other timeshares and was going to add my wife to our deeds this way until the requirement to be paid in full was added....spruce

The funny thing is: I'm a lawyer and I still feel a bit nervous about handling it myself!! :p I don't know anything about Florida law and I wouldn't want to screw it up -- real estate transactions are so persnickity. But, logically, I know you're right. The basic paperwork *should* be simple. But I'll still need to find someone in Florida to handle the recording, etc. Hmmmmm. I will speak to the Disney folks and perhaps to some of the people that handle resales and see what I can pull together.
 
Timeshare transfers will do the entire thing including recording for $250. They will also do a deed for $100. Recording is actually the easy part, just call Orange county and speak to the person in charge and get the info directly, how much and who to send it to. Good luck.
