IF Tom Cruise is listed on the birth certificate and they were married at the time of Suri's birth...he would be recognized as the legal father.

I'm not aware of the law where Suri was born (California?) but if they weren't married it may take an order to even establish him as the legal father regardless of that is on the Birth Certificate.

The easiest way would be if the (hypothetical) biological father stepped up and challenged paternity. Once paternity was established then that man could become the legal father instead of TC.

Katie's dad is a divorce lawyer...I'd guess that he has studied the laws in and out to make her a solid case.

They have spent almost no time together in the last 8 or so months. Not surprising to me in the least that this happened. I'm also pretty sure this marriage was contractual. That was and is still pretty common in Hollywood and definitely in the "church" of Scientology. As for Suri's genetics, I think she looks like both of her parents, but who knows? As far as Suri's concerned, Tom IS her father and that counts for more than anything else. That would have a large impact on any custody decision, regardless of who is actually her genetic father. As far as I've seen Tom has only seen Suri a handful of times in the last 6 months or so. He definitely doesn't seem to have the control over her that he did over his other two children. I'm thinking Katie is using what she knows to get what she wants.

The article says Tom was "blindsided". I just think she jumped the gun on him. He was probably going to make an announcement the way he did with Nicole, saying she "knew why" they were divorcing. I think Katie has the upper hand which is funny considering Tom's rep for control.

I'm not entirely surprised either. I used to like Katie Holms, she seemed so sunny and friendly. After she got together with Tom, she turned robotic and wooden. It was so strange. I hope she can make this a smooth transition for Suri, divorce is hard on kids. I also hope she doesn't just turn her over to Tom like it seems Nicole Kidman did with hers. If that were me, I'd fight for my kids and nobody would keep me from them. Is it really because of Scientology though, that Nicole isn't with hers as much? The whole thing sounds so freaking cultic.

Wow! I had to google him in images as I did not know who he was or what he looks like. Then googled Suri and seeing both pics is just a huge "wow" from me! She resembles Katie in many ways but boy, does she look like Josh Hartnett!

I think she is too. But you know, she comes across as a bit of a mama bear so I think she's ready for the throwdown with Tommy C. I hope she can keep Suri out of the freaky Scientology church though. Tom Cruise will make sure it is played out in the media for as long as possible. I get the feeling he is not concerned about Suri at all.

I hope she was smart before they married and set up a good prenup. Nicole Kidman pretty much lost her kids to Tom and Scientology. I bet Katie is going to have a tough time getting Suri away from that craziness.

I really think Katie will get sole custody becasue I truly believe that Tom is not the father. Look how much Nicole wanted children but she never had any with Tom that were bilogical and then when she gets with Keith- bam, she gets pregnant. I don't even think he will fight it.

I don't think biology will matter to Tom. Tom's other kids with Nicole aren't his bio kids, but he fought and won a nasty battle to keep the kids away from Nicole with the help of the Sci Church. He probably believes that Katie is the dangerous one to Suri.

Perhaps, but never is a loooong time. It's possible that one could pull away and decide to spill it all.

I read that one of the kids, now over 18 is finally reaching out and visiting Nicole. Legally, Tom has no longer a say in keeping the child away, no matter what the church wants.
