The 'other' Pete's random thought and rants

1) Jes, there is no need to apologize. I hope I didn't come off too strong. It is true they didn't get to a "court room" in a sense as there was no hearing.

2) I'm amused you've heard of "Fry." Frye does deal with evidence but specifically the admissibility of expert testimony. Frye was a 1923 decision from the D.C. Circuit (a federal court of appeals in D.C. as you might guess). It may still be used in some states but for federal law, it has been replaced by a "Daubert" hearing, named after a more recent (1993) Supreme Court decision. The difference is generally that Frye said the scientific principle had to be generally accepted. Daubert adopted a different set of criteria overruling Frye but saying general acceptance is one factor in deciding whether the expert testimony passes a smell test (i.e. is based on valid scientific principles). Like Mark Twain supposedly set, most people use statistics like a drunk uses a light pole, more for support than illumination.

3) Just to clarify, I practice in Tennessee.

4) I could not (nor would I want to) practice in Florida state courts without special permission. This is somewhat complex. For example, I can go to California and practice in a federal administrative proceeding but I could not set foot in a California state court without the permission of the court. I can still read, however, but that is a small substitute for being there and knowing the judges.

5) I do not disagree the American judicial system is complex but Jes will appreciate that a good friend of mine who used to be an incredible attorney lived down under for several years and always complained about how hard their legal system was to comprehend. It's always what you are used to.

6) FCRC can rule on "public accommodation" claims (i.e. non-employment claims). I doubt it gets called upon to do so very often. That is shown by the decision referring to Disney's failure to make a "reasonable accommodation" (an employment term) instead of "reasonable modification" of a policy which is the correct term in a public accommodation claim (go figure on the terminology). They didn't just get the terminology wrong, either. In any event, FCRC's decisions are not binding. Most court's don't even admit them into evidence if the issue goes to a jury.

I just woke up and decided to share this dream/nightmare

Even worse may be coming home from Disney and watching a video of some attraction or food I didn't know about while I was there. Between the things I know I want to do again and the things I need to experience for the first time, I'm afraid ten days isn't enough. I must now go win the lottery.

I just saw a video that had a croissant bread pudding with berries at Sunshine seasons. I don't usually eat there because it's always packed and loud and there are so many other things I know I like in Epcot, but now I need to go. It took years before I had a churro in WDW, mainly because my only other experience was at Taco Bell, but now I am addicted.

I am not an adventurous eater, but if you never had lamb or don't like it, try the lamb shank at the California Grill.

While typing this I am watching health videos to earn swag bucks and realize that I am not nearly as flexible as I should be. Let's be honest though, fried chicken is way better than being able to be able to do yoga. It's much more fun to go to a spin class and just sit in the back eating ice cream.

I had a dream last night (that I thought was real this morning) that the Frozen ever after ride was open for our trip, but the M&G wasn't open until December 2.

I had to go to the DIS to confirm this morning because i couldn't think of it was real or a dream.

I think because RoL won't be open for our trip, the Hulk is a maybe, BTMRR down for refurb, and there's something else that's "late summer" (maybe the chocolate emporium at UOR) I'm just a bit down that the roller coasters are down for my trip (I know, crap happens)

Ten days is definitely not enough at Disney. I never understand the "how long is your perfect trip" threads where people say 5 or 6 days. We've gone for 2 weeks multiple times and it's still not enough.

Plus, Disney is always adding new rides, shows, restaurants, shops, and more that make us all want to keep going back so that we can experience the new things.

As for Sunshine Seasons, that's #1 on our list of where to eat at Epcot. We always eat there at least once and often twice. I think it's among the best counter service locations on property with many unique items that can't be found anywhere else.
 
I'm having brain pain from watching other peoples Disney vlogs. You can not truly appreciate John Pete Kevin Craig and Ryno until you watch some of these other videos that are recommended to you by youtube.

As a side note, I never appreciated Craig until Dustin was gone, and never appreciated Ryno until he became more involved and started doing his shows. @Teleclashter @Ryno give me more goodness on a graham cracker with some chocolate. Wait, that sounds bad. Just give us more goodness to make up for this crap I have been watching. It really is like watching my great aunts slide show of her trip to Branson Missouri.

Back to my rant, spending a day in the parks and videotaping your entire day makes me think you didn't really enjoy your day. Spending hours editing it down to 20 minutes seems like a bigger waste. I am not a giver, I am a taker. I have to ask Jack to draft a petition asking youtube to give me back three hours of my life.

So far today I have seen people sitting on a couch showing what they bought in WDW, people sitting at a desk showing me the free stuff they got at WDW, two women sitting at a table telling me how they kind of liked Liberty Tree, and some guy who doesn't know how to use a go pro in Epcot but has a hot wife.

To busy myself I will now search youtube for videos of Waffle House, because I think that will be more interesting.

Now a poem for our trip to Disney, and for my Honey who is an English teacher so this should be on par with the 12 year olds you deal with daily. Maybe it could be a country song.

I go to work each day angry

LOL at PJ and Jes - I usually dream that I''m at the airport and forgot my plane ticket, or at WDW and forgotten my park pass, or something like that, and I DO fuss and worry over my ADR's a lot ahead of time to make sure I've got the "right mix" of old faves and new tries. Especially if I've got newbies with me, or even friends that consider me their "Disney Guru", that's a LOT of pressure! :confused3 Would be even moreso now, since I haven't been in so long, and so much has changed - I've not even seen a Magic Band in person.....I know....shocking, right? :)

And PJ - I say the same thing about lamb to people about the lamb shawarma (I usually get chicken and lamb combo) platter @ the Morocco pavilion!

Please understand that I am terrified of heights. I can only do ToT because I can't see how high I am, but Dr Doom will never see me.

I'm just horrible and listen to it AT work. And with no Disneyworld show last week, it finally got me off my butt to go into the archives and listen to the old shows. :)

I don't understand why my kid, who can be the biggest drama queen on the planet, has no fear on that ride when both her father than I have issues with heights. But then, neither of us can understand how to semi-introverted IT geeks ended up with an extrovert for a child. :)
 
I miss the Maelstrom. It was never a great ride, But for my first four trips it was either broken or had too long of a line. Therefore I fely compelled to finally get to ride it every chance I got.

Now that has become some Frozen mutant thing that Disney spent the past year slapping together, I will ride it one last time.

I know WDW is an ever changing thing, I think some old guy said that, but you don't waste good. Disney has enough to fix or refurbish.

Every morning when I wake up I make a point of hitting my head on the door frame of the bathroom. I do this so that, when I go into work, I feel like I am on the same level of intelligence as the people I work with.

I can't imagine (pun intended) how it must feel to be an imagineer and spend my day ask a desk, slapping my head, saying 'this is stupid this is stupid this is stupid'.

The Yeti is dead because they can't fix it. The same people that said "here's an oil rig in the ocean, let's use that to build a ride" can't figure out how to fix a hydraulic ape? It makes sense when you look at how long they took to build a parking garage. On paper the idea was great, but no one at any time in the planning thought 'the ride is going to shake this thing, let's reinforce it'? Hindsight is always 20/20.

The same could be said for Disney World as a whole. Some lackey may have gone up to Walt and said 'do we really want a park in a swamp that averages 115 degrees in the summer with daily thunder storms and sink holes'? Walt probably would pat him on his should just before security walked him off property.

I would like to add how happy I am that Jack pops in here. Other than the facts that he is smarter, more eloquent, and better looking than I am, @jcb is my mirror duplicate. I am the bizzaro Jack.
