Please don't get all wiggy at me for this, but...
The CM's are given the height restrictions and told that it is for safety reasons. As far as they know, a 39" child could be seriously hurt if they bend the rules and let them on. So they aren't trying to ruin your day. I know I would be a stickler, because if I let a child sneak by and they were seriously hurt on the ride, I would never be able to forgive myself, and I think most CM's feel the same way.
So go easy on them!!
Also, they can (and will) ask a child who looks like they have their shoes stuffed or who has obvious platforms to remove them.
Before we go every year, if one of the kids is "close" to a general height requirement, ie. 42 or 48 inches, I measure them and if they truly are close, we have a talk about how they probably cannot ride certain things, and then talk up what they can ride.
Of course, this year, my 2-year-old DD, who is 30" tall, REALLY wants on the TOT.
