Signature witness for buying resale?

1 of our 4 required a notary - we didn't finance and I don't know why. It was the first, none since then.
 
Only Fidelity ever required witnesses as a buyer for us. I do not recall the title company they were using. No other purchase we did required it.

You could inquire with your broker, otherwise it will be in the closing docs.
 

We're using Timeshare Store / Magic Title - don't know if that makes a difference?
 
For our contract where we used Timeshare Store and Magic Vacation Title, we did not need to notarize anything for sure :).
 
Fingers crossed we get the easy route then!

I'm pretty sure that when we bought resale we didn't need a notary but when we sold we did.

I bought two resale contarcts and I hadn't to notarize any signature, just have two witnesses sign the contract as well.
I read that the seller has to notarize the signature and living abroad this can be a problem because it requires a US notary, so you need to go to the embassy. However this is just what I read (not first hand experience): I hope it's not strictly needed and any notary would be fine as well.
 
Any idea why the one did?
I went back through my documents and couldn't find any that required a notary; so let's change that to 4 for 4. Two with Timeshare Titles and More, one with First American, and one with Vacation World Title.
 
It can be needed but it isn't usually. It will be needed if you seller is non USA or I think if they still have funding on it.

In the UK you have to go to the American consulate to do this if it is requested. Best to make the appointment as soon as you pass ROFR as you can wait up to 3 weeks. you can cancel if you don't need it.

This isn't good to hear. Our sellers are in Scotland, so unless TTS told them to make an appt in advance, we'll have to wait several weeks for them to return the docs. /sigh.

Not necessarily we just sold a contract and we are in Scotland. We returned our paperwork before the purchasers. Someone selling a contract should know what they are doing I wouldn't assume it will take any longer. We visited the consulate the day after we got our closing paperwork.

And the notary will stamp this with witness signatures already complete? Or the witnesses need to be in the room too?
Sellers need 2 witnesses for the deed, the notary can be one of them but must sign separately in the witness location, just being notarized does not count as a witness. For a buyer I don't think there's any legal requirements for witnesses or notary but different closing companies may have requirements as well as if one is financing and these will all vary.
 
I sold both my DVC contracts and am an Expat living in the EU. Will I need to go to the embassy to get my closing documents notarized?

We got our closing docs yesterday and needed a notary. :confused3 Also needed witnesses for one of the documents. We did it at our bank, the notary just used other employees as the witnesses. Once again no consistency in the process, oh well.

Did you finance?
We have yet to need s notary for cash contracts.
Now, we are Canadian and the notary process is much harder here, so maybe there are different rules for that. I wouldn't think so, but you never know.
