On the 26 th June me an my family went to Orlando for our first vist. We bought what is called the one ticket for the 3 of us costing over a thousand pounds.on the second day there we went to animal kingdom and were having great fun until this happened. The rain had started to rain heavy so we went on a little train that takes you to rafikis planet when we got to the platform at other end my son slipped on the platform and screamed in agony so much so that the pain made him sick.when I pointed to the guard on the platform that my son was in pain his response was that there was a wet sign on the platform as if to cover himself rather than be concerned about my son.also 1wet sign on that large platform is no where enough as we could not see it from we got of the train.the guard then told me my son would have to move so he could fill the train.I told him my son would not be moving until he was ready.it soon became clear my son had hurt his wrist badly and a ambulance was called. 30 mins later it arrived and took my wife and son to the celebration hospital. At this point when the ambulance arrived (30 mins)was when we first saw a manager I made my complaint and headed off to the hospital where it was confirmed my son had a buckled fracture to his wrist and was to have a cast on his arm for the rest of our Holstein.which meant he couldn't go to his fav parks which are the waterparks.

Your son had an accident and you are unhappy. I don't think it's Disney's fault, and Disney won't think it is either. I think you should get over it.

And what does "the rest of our Holstein" mean??

The only thing I see in your post that happened wrong was that the cast member was rude. Which is wrong, but not really something you should get compensation for.

I mean you said it was raining so obviously things will be a bit slippery and you need to be careful. Then your son fell which was an accident not anyone's fault and hurt his wrist, which I can see putting a damper on your vacation but still is not in any way Disney's fault.

This depends on the age of your son. The sign is there for people that can read. If your child is unable to read or to young to read , then Yes, you are entitled to compensation. Not for lost visits to water parks but for pain and suffering YOUR son endured. As a parent you may or may not be entitled to monetary compensation due to the cast member not "speaking" up about the slippery deck. Rain is a factor in the summer months in Florida. Care should have been taken via Disney to alert all guests of a hazard.

You may want to check into training of cast members on how to handle cases such as this. Some employers will go as far as to tell employees to do nothing.

Last, I would like to think your son will make a full recovery. A missed event on a vacation is not end of world. Your son could have been hurt much worse, although I am sure being in a cast is far from fun. I hope this helps.

You may also be unable to hire legal help in this matter. You can talk to Disney your self. Hiring legal assistance is what I would do. Lawyers will also tell you if you have options and what they are.

Ask your self was this Disney neglect issue or was it mine as a parent.

I'm so sorry your son was injured! I hope that he is healing well. It sounds like what happened was an accident and not due to any negligence on Disney's part. What kind of compensation are you looking for? I assume that Disney paid your medical bills. Did they offer you anything else?

I guess I'll never understand how someone can expect to get paid for an accident. I mean, it's raining..stuff could be slippery. Disney doesn't (as far as I'm aware) control the weather.

I hope you never have someone slip on your kitchen floor after the plumbing bursts. Of course that wouldn't be YOUR fault, as it'd probably be obvious the plumbing burst. You'd probably wonder why someone who elected to come to your house and could obviously SEE that your plumbing burst..would walk through your kitchen without being careful and then sue you for it.

It sucks. I'm sorry it happened. But it's life. Sometimes people slip. You failed to mention if the CM pushed your child down. If the CM did, then I'd for sure sue (the CM and THEN Disney). If this didn't happen, I can't really see how it's Disney's fault.

:confused3

Sorry this happened. At companies like Disney and many, many other places general staff is not allowed to administer first aid. Why? Because they aren't nurses and if they apply the first aid wrongly, disgruntled people demand compensation. Very similar to the OP's situation.

Cowboy up.

I don't think the OP was wanting the CM to administor any first aid. Maybe read it again.

And what does "the rest of our Holstein" mean??

Probably auto-correct for a "Rest of our holiday" typo :) I was confused too! I agree with everyone else, unfortunately, in that I don't think you're entitled to anything. If it was raining and there was a sign saying that the ground was wet and to take caution, there isn't much more they could have done. I agree that the CM could have handled it better, but I don't think you're eligible for a payout or anything like that.

If you're asking whether you have a cause of action against Disney, the answer is yes. Your son was injured on Disney property. Disney carries insurance for just such an occasion.

However, Disney will likely claim forseeability (it was raining) and assumption of risk (clearly stated on your tickets) as their defense.

You could probably get your medical bills paid simply by filing a claim.

However, beyond that, you would need to file a civil suit.

And who in their right mind could sue Mickey Mouse?:confused3

And any lawsuit must be filed in Florida. It is printed on the ticket.

If you've ever had your Holstein ruined, you know how painful that can be.

This topic only has one direction it can go.

Sure the OP has a case, there will be lawyers standing in line to take on Disney. The question is can they win?

Stranger things have happened in the past.

Lol,:thumbsup2. I don't think the OP is entitled to anything other than what Disney usually does for accidents on property. Not saying the OPs kid did this, but I see so many kids running at WDW, and then they fall or trip. Common sense will tell you that a wet surface is slippery, and if the child is too young to know this, then the parent should.

So your son slipped in the rain, and you want to blame Disney for this?

Pretty sure that rain is wet, no matter where in the world you come from
