Should Disney compensate me

To the OP: I hope your son heals quickly and has no lasting damage to his wrist. I am sure it put a damper on your vacation.

As for compensation, I have no idea.
 
The thing that concerns me most is the 30 min. response time by EMS.

A fractured wrist is not a critical emergency, to be honest. I was in a car accident that should have killed me, and EMS still took 15+ to respond, according to the police report.

Not to mention - they weren't exactly at the park entrance - they were at Rafiki's Planet Watch.
 
hire a lawyer threaten small claims court and they will settle for sure. not worth the hassle to them.

If the OP is looking for a legal answer, then you are correct. However, the way I read the post it seemed they were looking for more of an ethical/moral opinion answer. Which is, for the most part, the kind of answers that have been given. JMO
 
On the 26 th June me an my family went to Orlando for our first vist. We bought what is called the one ticket for the 3 of us costing over a thousand pounds.on the second day there we went to animal kingdom and were having great fun until this happened. The rain had started to rain heavy so we went on a little train that takes you to rafikis planet when we got to the platform at other end my son slipped on the platform and screamed in agony so much so that the pain made him sick.when I pointed to the guard on the platform that my son was in pain his response was that there was a wet sign on the platform as if to cover himself rather than be concerned about my son.also 1wet sign on that large platform is no where enough as we could not see it from we got of the train.the guard then told me my son would have to move so he could fill the train.I told him my son would not be moving until he was ready.it soon became clear my son had hurt his wrist badly and a ambulance was called. 30 mins later it arrived and took my wife and son to the celebration hospital. At this point when the ambulance arrived (30 mins)was when we first saw a manager I made my complaint and headed off to the hospital where it was confirmed my son had a buckled fracture to his wrist and was to have a cast on his arm for the rest of our Holstein.which meant he couldn't go to his fav parks which are the waterparks.


This one's easy. Not just no, but H&%L NOOOOOOOOO. :sad2: Accidents happen. It's life.
 
People need to be careful not to wear their "Disney can do no wrong" hat too tight in situations like this. It is admirable that so many people here have the "people should be responsible for their own actions" attitude, and "accidents happen" viewpoint. If only our court system had more of you sitting ing the jury box. But the truth is, things like this happen every day in supermarkets, movie theaters, buses, office buildings, sidewalks and dwellings and the injured people make claims, file suits and obtain compensation. You may not think it is fair or agree. But simple accidents do result in compensation. So I think it unwise to counsel a person who is obviously not from this country that compensation is neither warranted nor possible. You don't really know that.

Kid slipped and fell in the heavy rain.....sometimes you do not have to be there to now who's at fault....... :rotfl2:
 
At this point, I would let it go. I can't figure out if you paid for your water park tickets already or not but if you were worried about not being able to use the Water Park tickets because of the injury, you probably should have said something at the time! I would bet that they would at least have given you your money back for that if you explained the situation.

And the rude CM does bother me too. I've seen security/management come out of nowhere in a moment's notice when an incident occurs so it's weird that no one was there immediately when they saw someone was hurt.

On a side note, OP is clearly from Great Britain, the forefather of our screwed up legal system.

The best thing ever said about the British legal system is from Shakespeare . ."first thing we do, let's kill all the lawyers".

But what is the answer that is "deserved"? If this accident had happened at a British Petroleum gas station in Louisiana a month after a BP accident wiped out the Gulf fishing industry, people would be yelling "sue the s.o.b's". But people here love Disney, so it is all unicorns and rainbows and th OP should just go away. I think that a bit more of a practical approach should be taken with a non-resident who doesn't know how things work and may or may not be seeking moral/ethical/legal advice. "Put your big boy pants on" may be what you are thinking. But it may not be the actual answer to the question. Do you know for a fact that compensation is not an option? I don't. So I'm not going to let my personal bias get in the way of a legitimate answer.

And I'm sorry about your son. That is horrible and I would have been very upset too. I'm wondering, had the CM handled this differently, if you would have the same reaction wanting compensation. If he kindly bent down to your son and talked to him soothingly, told him he could get up when he was ready, apologized, gave him a pin or stuffed animal, etc., that may have made the experience much less traumatic and gave you less cause to be so upset. I don't know but it makes you wonder!:confused:Attitude is everything and the CM was definitely rude.

Ok, 2 different answers to this question.

If you're asking if you could win a lawsuit, I would assume yes. To me this is equivalent of people suing McDonalds for having hot coffee. Coffee=hot and wet rainy weather=slippery ground. Both things that should be obvious, but...

If you're asking if you should from a moral standpoint, no. Clearly you already agree with this or you wouldn't be asking us to tell you it's ok.
 
IMO, we live in a society where everyone has entitlement issues. If somebody has something go wrong in their life they deserve to have something given to them to make it better.
When the truth is sometimes life is not perfect, things happen. I think the best thing we can teach our children is that, nobody owes you something, you are not a delicate snowflake that will die if you are not coddled until you are 20.

Ask the poor soul who has a kid with cancer, or some deadly disease what they think of this kids boo boo hand.

I probably sound mean to some. But really, we live in a society where you can sue someone because the coffee is to hot!!!!!:confused3
 
To the OP: I am sorry your child had an accident, hope he is doing much better.

To everyone else on this forum, I love that there is one forum on this site that does not take everything said so dang seriously including the moderators.

If one falls due to natural causes, rain, clumsy, etc, I absolutely to do not think one is entitled to compensation I don't care where it happens.

If the walkway was defective, that would be different. But things get slick in the rain.
 
I do hope the child is doing well. I think most people on this forum sincerely care about the well-being of the child and would have offered help. Some on here on the other hand are . . . . well. . . . .Again I do hope he is better.

I cant believe how people attack others whether they are wrong for wanting compensation or not, a CHILD was involved. Just disagree and move on.

Several years ago my DD twisted her ankle getting off Buzz. I mentioned it to the first CM I could find (she couldn't walk without pain) and things immediately went into motion. A wheelchair appeared fairly quickly and a van picked us up (I think it was right in back of Tomorrowland) and took us back to the resort. We felt taken care of and would never have even considered compensation - not even for a moment. Its a shame OP didn't have the same great experience.

If the CM had a too bad/sucks for you attitude? I most likely would still not expect compensation, but I would have been just as disappointed and upset.
 
Again, we are talking about a kids hand. My daughter jumped off a swing set when she was 5 and broke her wrist. Took her to the Dr. they put it in a cast and we were on our way. I am happy to report she has not suffered any life altering long term issues from this traumatic incident.
 
That must have been horrible to see your child in such pain like that.

I don't know what advice to give you, but I'm really sorry that happened to your family. I really hope your child is well now. :hug:

This is nothing to do with it occurring at WDW, it has to do with a kid slipping and falling outside in heavy rain. A no brainer for personal responsibility if there ever was one.

The right answer to his question of rather WDW owes him compensation is clear...........NO!

Maybe he should contact one of those TV ad lawyers and they can give him a difference answer. :rotfl2:

The whole McDonalds coffee incident has much more merit for corporate liability that this incident IMO. As I understand it the coffee served was so hot it actually melted thru the cup (styrofoam) providing and causing sever burns. Not saying I agree with that case but at least the company (McDonalds) allegedly did something wrong by serving the coffee that hot.

Anybody want to point out a single thing that Disney was alleged to do wrong or negligent in the incident this thread is about? Just being on Disney property when it occurred does not equal a justifiable or winnable lawsuit.

Nobody is picking on the injured child, the OP asked "Should Disney compensate ME". And thus the replies are aimed at him not his child.
