Should Disney compensate me

I totally agree you have a right forcompensation. That is why Disney carries insurane, they carry in cas peopleare injurred on their propperty.

Thay charge you admission don't they.

I do not think any real neglect happened, but youy still were hurt on their property.
 
I honestly hope the OP's son is okay.

no you are not owed compensation. Your son slipped in the rain. It happens. As said up thread, he will heal move on.

I guess its not just Americans that are sue happy.

Suing just because somebody has insurance is plain ole stupid IMO. It is also not why companies carry insurance, to automatically pay folks who thru their own neglect hurt them selves. In this type of case the parents are responsible for the child's accident if they are two young to know better themselves. How many times have we all yelled at our kids for running, jumping off stuff, climbing on things etc......cause it's out job as parents, no one else's...........

What ever happened to personal responsibility? What are we teaching our kids?

The kid slipped in the rain because he was not being careful.....case close.

Man I wish I was the judge on that possible lawsuit :woohoo: I would shut that thing down in 2 minuets and have coffee and donuts for breakfast :thumbsup2

I really hope your son if ok, and I'm sorry that your trip was ruined. I guess If you really wanted to sue, you could. But really I can't see it being Disney's fault. When it rains, surfaces get slippery, not just at Disney but everywhere. Caution needs to be considered when walking. If your child is young and can't read, then you as a parent are responsible for your child. Again I'm sorry about your son, I hope he gets better soon.
 
This depends on the age of your son. The sign is there for people that can read. If your child is unable to read or to young to read , then Yes, you are entitled to compensation. Not for lost visits to water parks but for pain and suffering YOUR son endured. As a parent you may or may not be entitled to monetary compensation due to the cast member not "speaking" up about the slippery deck. Rain is a factor in the summer months in Florida. Care should have been taken via Disney to alert all guests of a hazard.

You may want to check into training of cast members on how to handle cases such as this. Some employers will go as far as to tell employees to do nothing.

Last, I would like to think your son will make a full recovery. A missed event on a vacation is not end of world. Your son could have been hurt much worse, although I am sure being in a cast is far from fun. I hope this helps.

You may also be unable to hire legal help in this matter. You can talk to Disney your self. Hiring legal assistance is what I would do. Lawyers will also tell you if you have options and what they are.

Ask your self was this Disney neglect issue or was it mine as a parent.

This may have been mentioned, but, if OP's son couldn't read, then it was up to OP and his DW to take the young one by the hand to get off the train. Even when I could read my parents would still take me by the hand for stuff like this.

With that being said, visitors to Florida should be aware of the following:

1. Summer is the rainy season in Florida.

2. "Rainy Season" generally means that it tends to rain...a lot.

3. When it rains, the ground has a tendancy to get slippery. This is not exclusive to WDW. Or Florida. Or even the U.S.

4. When the ground is slippery, people should take caution to avoid falling down. And parents should take extra caution to assist their small children on stairs and other potentially slippery surfaces.

5. Disney should not be held responsible for numbers 1 - 4 listed above.

As for the rude CM, rudeness is unacceptable. But rudeness is not justification for compensation or a lawsuit.

There's a reason we carry our health insurance cards with us when we're in the parks.

The thing that concerns me most is the 30 min. response time by EMS.
 
I never had a holstein ruined BUT I did once have a Bob Mackie ruined.
Just sayin'.
 
I am sorry your son was injured while on holiday. As a parent, it is our responsibility to keeps our kids safe and aware of the dangers around them. I do not see where this is Disney's fault and asking for compensation would be greedy.

A fractured wrist is not a critical emergency, to be honest. I was in a car accident that should have killed me, and EMS still took 15+ to respond, according to the police report.
 
People need to be careful not to wear their "Disney can do no wrong" hat too tight in situations like this. It is admirable that so many people here have the "people should be responsible for their own actions" attitude, and "accidents happen" viewpoint. If only our court system had more of you sitting ing the jury box. But the truth is, things like this happen every day in supermarkets, movie theaters, buses, office buildings, sidewalks and dwellings and the injured people make claims, file suits and obtain compensation. You may not think it is fair or agree. But simple accidents do result in compensation. So I think it unwise to counsel a person who is obviously not from this country that compensation is neither warranted nor possible. You don't really know that.

My dad's dialysis port burst open and it took EMS over ten minutes to get here when they are five minutes away. Did I mention that my dad had been bleeding for a while?
