This would be another reason why Fidelity seems to get more of the bargain contracts. I'll bet they still get the commission though, the sales people are going to get paid and I don't see Disney or Fidelity taking it out of pocket so that only leaves the seller.
Yes, the listing agent gets a commission. DVC has the "right of first refusal" which means they step into the shoes of the buyer. The sale still occurs with all provisions of the P&S intact, its just that DVC becomes the buyer, not the original purchaser. The commission comes out of the sellers proceeds.
