I was preparing myself to hear the worst and I got the email this evening:

It Passed!!!!!

I still can't believe it!

So does anyone notice a trend or have any thought on if Disney seems more likely to take a contract where the seller is paying the fees on the current years available points?

It's really hard to tell what contracts they'll take back. I thought it was only contracts that are loaded -- but I've seen them take stripped contracts as well. At best, it seems like only BWV, SSR, and BLT that they're focusing on right now. Even then, some have speculated that it might only be certain "units" (i.e., actual building units) that they're taking. Not sure why that would make a difference -- but price per point and overall price is definitely NOT the only determining factor.
 
Getting anxious. It's been over 30 days and FIDELITY has not heard yet!


35 days and still waiting. There have been many contracts approved after ours.

I still have not heard back from FIDELITY after sending them an email and leaving them a voice mail. That's poor customer service.

I wonder if the contract was not received by Disney and I need to wait another 30 days?

I would say your odds have not changed. Less than 5% that Disney takes it. Greater than 95% that they do not take it. Odds of poor customer service = 100%.

The same thing happened to me with The Timeshare Store. I never heard back from ROFR and I was going nuts after 35 days. When I finally reached them, they said it had passed 10 days ago, and they were "surprised" that nobody had notified me. The problem happens most often when your salesperson goes on vacation. The person who is backing them up may be indifferent about handling the administrivia while getting no compensation for it.

Technically, Disney has until the date of closing to take your contract, but in practice, they let your broker know about 30 days before closing. I would keep calling your broker and you should get an answer.

That is horrible, I think I'd have them on redial until I got a human.
 
FIDELITY nonchalantly replied to my latest email that it passed ROFR. I also contacted Duncan Title & Escrow who is their title company and they informed me it passed ROFR on 8/1/2016.

Look out BWV; here we come!
Congratulations It's great that you passed but The fact that they didn't let you know right away is aggravating. Have they no idea how stressful the waiting is? Hopefully you will receive your closing documents soon.

With regards to Disney buying back ones with sellers paying MF- yes, it ends up being less per point, so it's attractive. That being said, the pool they are currently pulling from has an inordinate number of contracts with sellers paying the current year's MF, so that might be skewing things too.
