Returning a 'used' broken product after buying another...

Do you return the broken 'frame'?

  • Yes, if less than 6 months old it is still in the 'new' and the packaging doesn't matter

  • No, that it is unethical to return it in other packaging

Deciding to use subterfuge to return a package is always a moral dilemma. But warranty-return policy problems, like many are more complex than they may appear.

Companies often warranty products for many fewer months than what an average consumer expects to be the normal life of a product. Manufacturers too often opt for very short terms of the published "express warranty" hoping most consumers will not be aware there is also an "implied warranty" that keys into what an average reasonable consumer would expect the life of a product to be. Consumer Reports explains this well at consumerreports.org/cro/2010/09/your-rights-as-a-consumer/index.h__ . Look for the heading "Your refrigerator dies three months after the manufacturer's warranty expires."

Working against the natural selfish tendencies of manufactures and retailers are federal legislators like the ones who signed into federal law the Magnuson-Moss Warranty Act which protects consumers. Just because one is told the "express warranty" is expired, does not mean that the purchasing consumer does not still have warranty rights. Many companies including Amazon have arbitrary limits on how long you can wait to return a product. Does that mean the warranty is over? Companies use lots of gimmicks to limit warrantees but federal law trumps company's attempts to escape responsibility for manufacturing quality products and standing behind them.

One of the largest and least ethical cheap tool retailers wants consumers to believe that if one either loses their receipt or the express warranty runs out that the manufacturer and vendor are off the hook. I overheard one shopper at this chain, when pressured to purchase an extended warranty respond, "don't worry, if this tool breaks down in the next five years, you will be getting it back through your front window." I'm not recommending vandalism just advocating that we as consumers hold manufacturers and venders "feet to the fire" in demanding quality and responsibility.

Back to the original example Interestingly, Wal-Mart generally will not accept returns without the manufactures packaging. I returned a product once there with a receipt but no packaging and Customer Service advised me to buy a new identical product, put the old product in the new box, after which the return was accepted. When dealing with unethical practices by companies trying to escape appropriate warranty responsibilities, it might not be a good idea to "bring a pea shooter to a gun fight." I am not advocating for being unethical, only for being educated and fighting for our rights, including educating ourselves on the rights we may not even know we have.

After six months it is yours for life. The idea that you want a refund and still keep the frame is mind boggling. Even if you returned it what reason would you use. If it's broken why would you want it but after all that time how do you prove that you didn't break it. If it isn't, well, you knew what it was when you bought it. Chalk it up as one of your mistakes and move on.

I don't think the plan was to get a refund plus the frame. I thought the plan was to use the new box to return the broken frame and exchange it for an undamaged one. Then the OP would have paid for two frames and own two god frames.

But otherwise, I agree with you. After 6 months, it is yours. Any manufactures defect should have been noted and handled way before that.

You bought a product less than 6 months ago. This product should last longer than 6 months. For kicks, lets say it is a photo frame. Less than 6 months later, the frame is broken. It is still usable, but broken and looks cheap. You buy another one (not a replacement, but an addition to the current frame, You want both). Do you return the broken one in the packaging of the new one (they are identical) or not?

No, but as a former website administrator, it is the preferred way to operate a message board. Fewer posts make for happier users. This is the only board I have been on where a "Zombie thread" exists. I found one thread on one of the classic car boards I visit that went back 20 years.
