Resale Contract Closed, but not getting contracted loaded until after 7/8/2022 over 60 days from closing? Advise wanted

The VGF contract I bought just closed recently. How soon would it show up on here?
Did it close today? If it did I'm guessing Monday.

Usually takes about 1 to 2 business days for it to be processed at the Comptrollers. But sometimes it will show up the same day as the recording.
 
If you bought VGF direct, Disney is not the fastest at recording the deeds. Sometimes the same day, sometimes delayed. And it is possible to split payments and delay close in direct sales. If you did that, the deed could be delayed many months.

It depends. I’ve had some show in a day and others a few days later, depending on day of week we actually close and if there was a holiday.
 

Thank you all I'm going to push the broker some more on this as I hadn't heard back from them today yet, like they said they would. I'm also making it known I was going to be using some of the 2024 points on a 2023 trip that I was booking and will not have to use OTU points.

Did you go back and check your paperwork to see if there is anything at all that indicates a delayed transfer?

IMO, I’d push MA if you want the contract transferred ASAP.

Legally, you own it..and delaying the transfer and allowing someone to use your contract without your approval is wrong and may be borderline a violation.

Broker and agents messed up and of course they want you to simply let it be delayed. And if they can keep you from pushing g the issue with MA, they will.

Honestly I would just push on MA to cancel the trip and transfer it over.

Let the seller sort it out with the broker. One of them messed up big time. It may have even been the seller that screwed up. But if it was the broker, the seller can just book their trip in cash rooms and pressure the broker to reimburse them.

It’s a crummy situation all around but none of this is in any way your responsibility.

Here’s the emails you need. MA and Bill. I’d be on the phone also with MA. This is an issue Disney needs to handle.

This is overkill for minor issues, but this is not a minor issue. I’d be escalating this until I got to Disney legal with a real answer. I’d absolutely put in writing what the broker said to you. See if Disney wants to be part of this mess or not.
 
So if the seller cancelled the trip, could they theoretically keep the contract longer until the points are spent/expired? If this is even possible, then another reason to advocate for having the contract transferred ASAP and let the seller/broker deal with that trip. So sorry OP, this seems like a mess and wish we could find out who the title company is that botched this up (was able to deduce the broker based on some googling).
 
Thanks I'm reaching back out to the Title Company to see if I had signed anything that showed a delayed transfer of ownership. I looked through my docs and didn't see anything.

Great point. I hadn’t even thought about that aspect of it. Technically the answer is no because now that they don’t own it, it should be canceled anyway.

But, if MA is saying they would not transfer until it’s done, then who knows what they might do if that happens. It’s one of the reason why closing doesn’t ever happen before a trip is over.

I sure the broker did not want to say anything else, you kinda have him in between a rock and a hard place and his license could be at jeopard. Best course of action for him would be to slow play this.

The last thing he wants is you going around him to MA and having them change the membership now, or call the licensing board…

I have a feeling MA was told this contract will close after the trip, that is why it is in the pending file. If the OP wanted to force the issue, I think MA would change the membership once they were provided the deed.

i was being lazy on telling them about a transfer from me to a trust I set up from my kids. When I added points at RR I mentioned in passing that I had not done the member ship transfer yet. About 2 hours later I got an email from MA staying my membership transfer was complete…

The last thing Disney wants is to be part of something that is sub par…. They have the deepest pockets and the most to lose by not following their own rules.
 
It is true that MA normally wouldn’t know until the title company send them things…I am sure they don’t monitor that.

But, the OP confirmed with MA that the title company did send the paperwork in to them, but it was decided by MA to allow the reservation to stay in place and not close it.

So, at this point, MA is being complicit in allowing the previous owner access to the new Owners contract Sure, it takes time for the transfer to happen and resale owners do have to wait…but in this case, it’s being purposely held back for transfer outside normal times.

As I said, I give OP credit, because no way would I be this nice. I’d tell MA they need to transfer it and if the previous owner loses the reservation, so be it…they can go after whomever messed it up by not disclosing the delayed closing.
I would love to know what that paperwork list as a closing date.
Does it list 5/?/22. Or 7/8/22?

That is the real question…. My guess is the later.

The OP talked to MA who confirmed that the title company sent over the documents saying the contract was closed. So, MA knows it’s been done…that is not in dispute.

I have done several delayed closings and in all cases, nothing was sent to MA until my trips were done and we officially closed the same day as check out.

Closing documents have always mentioned the delayed close as well so it’s not just a date, its clear that buyer recognizes ownership won’t take place until later.

I sold a contract in March with a closing date of May 21st and we had no reservation so having a date farther out doesn’t mean anything. It’s whether it was disclosed to the buyer. The fact that the title company actually closed the contract leads me to believe that someone wasn’t upfront about the reservation and it was discovered after.

Maybe the owner moved the trip after the deal was done to July and never told anyone either.

ETA: Also, with a delayed closing, paperwork has never been sent until 2 weeks prior to the expected date. I have been through 4…two as buyer and two as seller.
