A little background....My son's father and I have been split up for 3 years. We tried shared parenting (not through the courts) and it worked the 1st year. After that he slacked off and he started seeing him once a week. At that point, I filed for child support and was given the amount of $200 a month because he claimed he worked 20-30 hours so thats what they based it on. Shortly after he switched jobs and I know he now works 40 or more. I didn't file for a review because I didn't want to cause any problems between us. It has never been very civil. He hasn't seen or talked to my son in a month and a half. He doesn't reply to any communication at all. I have decided to request a review for the child support. The form they sent me says if its been less than 36 months, I have to show proof of the reason I am requesting it. There are 2 reasons, 1 being he is no longer part time and another his income has more than likely gone up more than 30% because of his full time status. HOW do I get proof of his income? This makes no sense to me whatsoever. I have no access to his income or employment information. I have tried to call but due to the economy the office is short-handed and I just waited on hold for 25 minutes with no answer. Shouldn't they request this information from his employer? Any advice?

TIA!

I would just call the Attorney Generals office and ask them. I asked for a review of our case but it had been three yrs so they needed to update anyway.

Usually, you put in your request with CS enforcement, they then send a letter out to the other party (your ex) and give him a certain amount of time to respond (I think 25 days, if I recall correctly). The child support is retroactive from the date you applied.

I am shocked that they allowed him to get away with putting twenty to thirty hours. Housewives are imputed at 40 hours of pay based on their skill level when imputing income for child support...but then this is also based upon states that use both income to imput child support...

In our state you would request a review based on a "substantial change in circumstances". The change would be his job change from part-time to full-time and you can also allege "that upon information and belief" he has had a substantial increase in earnings, even without having the information.

He was working at a job that varied from week to week, They used his last 4 check stubs and calculated it. I on the other hand, the sole person that takes care of my child, works 40 hours a week gets $200 a month. I guess I could not get anything at all like some people. I just worried because the form I filled out said if I didn't provide proof that it would be automatically denied. When I call, they say its been longer than 3 years because my account was not updated from a former case back in 2003. I guess I could just try, request it and maybe attach a letter as to why I think he makes more money now. Thanks for your responses!

I think when you take him to court every three years, he has to present proof of earnings. I have heard that you are allowed a copy of his tax return every year. I dont' know if this is true but it may not hurt to find out.
