Would like some clarity on the rental situation

Interesting fact. Emails were sent regarding the VGC refurb. Some said DVC wouldnt care. Well low and behold they cared enough that they put a full page spread in Disney Files about how they heard the members. But in the end even if they dont care why roll over and say nothing? If thats how you like to live your life more power to you.
Apparently lying is better than expressing how you feel 🙄🙄

I don’t like the way DVC has chosen to approach this issue. Basically they are forcing people to become experts in this one very specific area of use in order to access it. I want them to address patterns of commercial activity; I’m just not sure this is DVC’s best option. Which members are least likely to be stymied by these questions? Maybe those with good reason to have already become experts due to their own patterns of questionable use?

Anyway, if I do a rental in the near future and am questioned, my plan is to let them know:

It is a rental with a contract in place. 90+% of my membership usage includes DH and I, the owners, on the reservation. Clearly my pattern of use is personal as I, the owner, am partaking in all of those trips. On very rare occasion I have unused points, and in such case I may legally rent them, as I am doing now. As a member I’d prefer if DVC more clearly defined what activity constitutes prohibited use. 20 reservations seems odd as a threshold.

I don't either which is why I was so frustrated at the fact that dvc let's you define it for yourself, but then makes you question your definition.

Someone commercially renting would obviously be more comfortable with just lying as it is easier to do so and they must to continue what theyre doing, so those not doing it are the ones left feeling bad. Not cool. Obviously this strategy isnt working and I know if Disney could outright ban renting they would. But they can't. And im not sure they can even legally stop commerical renting, not a lawyer, so we're left in this gray area having to come up with long explanations we hope are acceptable or revealing our personal business.

I suppose I should start writing my script in case I run into this situation again (hopefully not) Ive already begun my email to them regarding this.

Here is what I know and have it from DVC….you can rent to anyone including those you don’t know.

The rules have not changed. What has changed is MS trying to imply things that are not true.

Nothing in either the contract or FL law requires owners to meet specific criteria to exercise your right to rent.

So, my advice is to agree it is personal use an complies with the contract.

Thank you, I wasnt prepared for that, but now if I have to rent again I will answer the question with more confidence!

I honestly would love if that happens to me.

"No, this isn't exactly personal use, but I'm personally renting my points to a third party. Is that enough to satisfy this requirement? As far as I'm aware, FL law allows me to do this. If that's not the case, I need a formal communication in writing informing that I'm not allowed to rent and why the law doesn't apply in this case. After receiving it, I'll gladly call back to cancel the reservation. Now, the names I need modified are: ".

Probably nothing will happen, but that's going to make my day 😂

I seem to always get the ones that overreach 🤣

If this is their ****ty way of "enforcing" the no commercial renting policy, it sucks. No one should feel that they are in the wrong when occasionally renting.
Its one of those situations that you look back and think of all the things you could have/should have said 😪 I was nervous and kind of fumbling my words. These guests are depending on me for their vacation and im sure super excited and Disney vacations aren't cheap. I didn't want to mess anything up.

Why wouldn't just say there family and be done with the whole conversation.

The fact that you really think they care is comical.
Unfortunately, very early in our membership I learned exactly how little DVC cares about its members. They put out a survey, asking the membership their opinion of adding a pool slide to the OKW main pool (maybe they just asked OKW owners). For whatever reason, the members voted against it. Shortly thereafter, it was proudly announced at an annual meeting that DVC was adding a pool slide to the OKW pool. So why did they ask for members' opinions?
I can't help but wonder if part of their strategy is to intentionally push the issue about who's using the reservation, and hope they rattle you. Besides aren't they friends now that they gave you money?

I would be nervous too if a stranger’s vacation was dependent on me. But if it was just my family, I like to give outrageous answers to intrusive questions 😉 I would have told her it was my pimp, because groceries are expensive, and my baby daddies are in jail.

Did they share the results the survey?

With these names that sounded like they were on the opposite side of the globe, I could have probably came up with something wild 🤣

Just refer these intrusive CMs to their own FAQ's...

Vacation Points Overview - Frequently Asked Questions

Q: As a Disney Vacation Club Member, can I rent my Vacation Points?

A. Members may rent their Vacation Points. However, the use of your Vacation Points for commercial purposes is expressly prohibited. Commercial purpose includes a pattern of rental activity or other occupancy by a Member that the Board of Condominium Association, in its reasonable discretion, could conclude constitutes a commercial enterprise or practice.

This is what I would answer:

I appreciate your help with the matter and I understand you're asking because DVC is trying to identify and stop commercial renting.
However, my reservation is for personal use, as defined in my resort Public Offering Statement and by DVC rules. I do not appreciate you asking to explain who my guests are and if you insist I'll have to ask to continue this conversation with a manager.

I do not like to lie, even white lies and I understand the OP frustration.
My frustration comes from the fact they look to be harassing normal members while businesses with thousands and thousands of points continue without a itch.
