Proper Etiquette for moving out timeframe

At the minimum I would pay her until the 7th, if I wanted to end things on good terms I'd say thru the 15th since that's what she is asking. If I wanted to remain friends and really take the high road, I'd pay all of September, but I'm thinking that you and her won't be remaining friends.

Her reaction to you moving out (thinking that you were going to live there indefinitely) and especially to you having your boyfriend over for dinner make me wonder if she had more feelings for you than just friendship. Sounds like she had expectations and was jealous beyond what a normal friend might be.

Im not going to opine on what you should do as, like always, Im sure there are different sides to the story. I just want to comment on the legalities.

You may not have a written agreement but if , hypothetically speaking, she were to take you to small claims court, she has a strong case. There is loads of proof to the fact that you have a verbal agreement and those can be just as legally binding. Only certain "deals" must be in writing , such as purchasing real estate, but verbal agreement involving tenancy are perfectly acceptable.

1) You have posted on the internet, publically admitting, that you had a deal and that you were going to pay her to live there
2) You have cancelled checks, albeit made to cash, but cashed by her to support this claim
3) Im sure there are other people out there that can affirm that they are aware you have this agreement.

Each state has different rules. The issue isn't whether its legal but whether is enforceable. And I see an offer, an acceptance and payment making a completely perfectly legal and enforceable deal. But then again, depends on the state.

As far as the poster who talked about the IRS, that only applies to rental income to make profit. Her payments directly offset expenses incurred by her roommate. Roommate money is not the same as rental income.

This is how Ive always understood things but feel free to correct me if Im wrong. I know because of a friend of mine was in a similar situation.

I found the rules for New Jersey:

Ending a month-to-month lease. To end a month-to-month lease, or any rental agreement that does not have a specific lease term, you must give a written one-month notice before the month starts. You can then move out at the end of the month. Cite: S. D. G. v. Inventory Control Co., 178, N.J. Super. 411 (App. Div. 1981); Harry’s Village, Inc. v. Egg Harbor Tp., 89 N.J. 576 (1982).

For example, say that you have a month-to-month lease, your rent is due the first of every month, and you want to move on June 30. You have to give the landlord a written notice before June 1 saying that you will be moving out as of June 30, and you will end your lease at that time.
