Points in Raffle?

I am a Director on an Education Foundation For Land Surveyors. We do a annual raffle to raise money for scholarships, to help land surveying students attending college in our state.

We have been thinking of getting a DVC membership, purchasing around 200 points and conducting a fund raising raffle where we would offer someone the ability to stay at Disney for a week or two week vacation, and we would use the DVC membership to allow this event to happen.

Does anyone know if there is any thing wrong with this idea? Would it be the same as if they were renting points? Does Disney have any problems with being able to delegate who stays at the resort on our membership?

Members are allowed to make reservations for others. The only problem I see is that your membership would be for the *sole* purpose of making reservations for others.

There is a prohibition against 'commercial renting' in the contract. There's no specific definition of commercial renting given, as far as I know it's pretty much whatever DVC decides it is.

This is for a non-profit purpose, so I don't know whether Disney would consider it commercial or not. Your best bet would be to contact a DVC guide and explain your situation.

One thing to consider.....the owner is responsible for any and all damages and unpaid bills left by those using reservations you've made for them. So, if someone who wins your raffle does some damage in the unit, and they've either left no credit card or an invalid credit card (it happens), your organization is going to be on the hook for the money.
 
Corporations and businesses can be DVC owners and the rules may be a little different for them. I would contact Disney for more information.

I don't think you'd be able to take a deduction against any taxes, don't know if that applies in your situations with the likely not for profit status. You should also check with your lawyer to see if it's actually allowed for a not for profit to own such an entity under their umbrella. Since renting is expressly allowed and it's unlikely we're talking big dollars or numbers of points, I doubt you'd have any problems on the DVC side. Your problems would be more on the side if they points were used by employees, officers, etc. Again, something for your lawyers to help you with the ins and outs. From a financial standpoint, I doubt you're make enough money to justify the purchase, I wouldn't do it.
