I know it could have been much worse ( I am VERY grateful it was not bad) and in the grand scheme of things this is nothing. But I am mad someone hit my car. There is some damage, but it appears minor. My neck and back are sore. But THANKFULLY Morgan is ok.
We were leaving Target and stopped at the exit of the parking lot at the bottom of a small incline. The woman behind me hit me when her "foot slipped" coming down the incline. She got out of the car saying "I'm sorry, I'm sorry, are you ok?" I got out of the car and went to check on Morgan. Once I knew she was ok, I was able to speak. The woman told me she was wearing flip flops and her foot slipped and she hit me.
The officer came and told me that since it happened on private property he could not "assign blame" or even write a ticket. (Is it not still a crime?). The woman admitted she was to blame. The cars placement back that up. I thought that when you cause an accident, you get a ticket. The insurance company of the ticketed one pays right?
I have never been in an accident. I want the damage to my car fixed. If I call my insurance company, will I have to pay my deductible? Am I supposed to call her insurance?
Depends on what state you live in. Some states are "no fault" meaning that your own insurance pays whether you are at fault or not. And, yes, you typically have to pay your own deductible. Call your insurance person - they can give you all the info. you need.
