Better go speak to them NOW before the tree is in the ground. Corner them while they are mid process and be as nice as you can, remember they do not have to comply. Maybe if the landscapers can give you a "best place for the tree to do well" you will have them on your side.

Just go to the landscaper and tell him to move the tree over 5 feet and that the owners won't mind.

Talked to the neighbors yesterday, was told sorry.

Now I ran a quick errand in that time the whole yard has been torn up. There is more going on than just putting in a tree! Neighbors didn't tell me that. Of course, it is right up to the property line (at least where they think the line is, they didn't get a survey done)

Of course they have to stand in my yard to get some of the grass up. At least now I know why they needed a bobcat.

Personally, I cannot imagine this kind of angst over a tree (unless it were a tree that was about to fall onto my roof or something).

The city approve a zoning change to change the "green space only" zoned area right behind my house. Next summer a 30 meter tall building with 12 studio apartments (aimed at students) will be built 10 cm from my back fence (we have a small yard too--this is maybe 15 meters from my house). I am upset by that--but not more so than you seem to be by a TREE

It's just a tree! In their yard! Not sure what all the outrage is about. If I want a tree in my yard ill plant one. No way would I ask my neighbors permission. I can't imagine living next to someone who would make such a big deal over a tree. I love trees, shade, and privacy. And the more trees the less I have to see my neighbors. Maybe that's why they want it.

Walked out my front door a few minutes ago to put a letter inmailbox. To my surprise there is a T190 Bobcat and a commercial type lawnmower sitting in the middle of MY front yard.

Now THAT is unacceptable and you have every right to be annoyed by it.

I have been nothing but nice to them. We were outside talking, being neighborly when the tree and other plants were being delivered. I asked where it was all going since the front of their house has very pretty azaleas, butterfly bush, and some holly bushes. They never really told me where the bushes were going just where the tree was going to be put. I mentioned don't you think that is a little close to the property line? That is when I got the response that I did. Never was ugly with them and have never done anything that would interfere/harm their property.

Wow! Rezoning a green space only for apartments. Yes, I would imagine you being upset with that. Did residents get to speak out about the change?

Yes, I was annoyed with that too but again I spoke nicely, not to the neighbor this time they aren't home, but to the landscaper. He was very nice and accommodating.

I found the gas company digging up my front yard........some neighbors were paying to have a gas line pulled into the subdivision. They told me they had an easement. I got the subdivision maps that I got when I closed escrow, the easement is on the BACK of my lot, not the front. They came out and resodded up they dug up, and quickly took action to get an eastment recorded on the front of the lots.

It will be about 3 feet from the Crepe Myrtle, which the Crepe is only about 2 feet off the line. Now the property is a pie shape so it widens a bit, but I would need to go measure how far it would be off the line. Not going to do that right now. So it should be maybe 2-3 feet from the line? I am guessing here.

If there is a sewer line there, there is an easement there. Probably only for the sewer district, but there can't be a sewer line there without an easement as they could need access to it.

So that is how it works. We were just told that if we put a fence up near or on the property line, since it is also the sewer line, that if the town needed to get to it, they could rip out the fence and it would be our responsibility to put the fence back. Town ordinance says 10 feet but the town really doesn't "police" whether fence is 10 feet away or not.

Ok, so I mentioned to the landscaper who appeared to be in charge about the sewer line. He proceeded to say a 4 letter word starting with an S.

Tree is now dead center in front of neighbors bay window with shrubs around it. If this is how they are going to put it in, it actually looks rather pretty.

Originally, the tree was off to the side and shrubs were arranged under and in front on the bay window in a pattern of some sort.

Neighbor came by (husband) and told me that if I wanted any of the sod pieces that were torn up to put in any bare spots I may have. I thanked him for the offer.

I asked him how it was going. He said besides a few design changes it was going well.

So, I am a happy camper.

This is a very interesting thread. It always amazes me when people want to control what someone else can do with their property. My neighbors paid for their land and they pay the property taxes. I don't live in an HOA, and as long as they are abiding by the local laws, it's none of my business what they are doing on THEIR land.

OP - I'm glad you are happy that the neighbors met your needs.

Forgot to add, that yes the HOA does have some say so on what we can do to our yard and house (exterior), but we knew that when we bought.

That's too bad about the Bermuda grass requirement, as well. Could you apply to the HOA for an exemption for that space, on the grounds that some grass of a different species is better than bare ground? Or put in a shade garden in that spac

That's the best solution: a shade garden. Don't try a shade tolerant grass. Get some nice hostas, ferns and other shade loving plants. Fill in between them with impatiens or begonias. Nice colorful garden instead of boring grass.

I see the neighbor decided to move the tree over a bit. I still recommend removing part of the lawn for a garden if the shade hits that area, but don't plant it over the sewer easement.

I love love love magnolia trees and the smell of magnolia! I have always wanted one! I have fond childhood memories of the smell of magnolia in the air.

Uh oh. I may have become a tree hugger. It might be the night shift turning me.

They are a beautiful tree with a wonderful frangrance.
But when they start to drop their flowers, they make a HUGE mess.
