Neighbor planting tree near property border. Update #72 problem solved

No city ordinances that I could find. Going to call the HOA tomorrow.

Tried talking to neighbor and was told, we will plant what we want. I would have to deal with it.

I reminded them I dealt with them damaging trees in my backyard, when they had tress cut down in their back yard. They had tall pine trees cut down and the person cutting let them fall and damaged 2 Japanese Crptomerias and left huge indents in the yard. Also, when the husband thinks I mowed a bit of their yard, they put up stakes and a rope to mark the line. This of course is according to where they "THINK" where the property line is located.

In the end, I am probably going to have to do a wait and see what happens. I think it is going to be ugly so close to the Crepe Myrtle they already have.
 
I just want to say GOOD LUCK!!! I understand your thought process. Our neighbor put an apple tree right next to our fence. We knew it would cause a big huge mess and of course it is. Why should I have to pick up rotting apples in my yard when I didn't plant the tree. Why should I have to pick up apples that have bees swarming around them? Why should I have to smell them rotting? They don't cook so there was no reason to plant a big apple tree. We did talk to them about it and they are now cutting it at the property line but it doesn't help when it's windy or the squirrels steal a few and drop them in our yard. The wife no longer talks to us.
 
I think you're out of luck. If it's on their property, they can do what they want. When it's bigger, I think you'll have the right to trim any limbs that come across the line onto your property, but that's about all you'll be able to do.

Interesting thread. I can see being annoyed, but I have to be honest, I'd be a whole lot more annoyed if a HOA told me what I could or could not do in my yard, whether it be trees or what type of grass. But, of course I realize those type of restrictions have to be disclosed before you buy.
 

It's just a tree! In their yard! Not sure what all the outrage is about. If I want a tree in my yard ill plant one. No way would I ask my neighbors permission. I can't imagine living next to someone who would make such a big deal over a tree. I love trees, shade, and privacy. And the more trees the less I have to see my neighbors. Maybe that's why they want it.

OP - check with the rules in your state for alternatives to grass. State rules trump HOA rules. Here some use a ground cover that does well in shady areas.

It is in the HOA covenants that if you change landscaping in your yard, you have to submit a plan. Most get approved.

Yes, the tree will be in their yard, but it will impact MY yard due to how close to the property line it is being planted. It will shade the grass in my yard, thus the Bermuda that I am required to have in my yard won't grow.

When the leaves fall, and if this tree has those other growth things on it that sheds, I get to clean up the mess also. I did not ask for this.

Now if I planted something like that near the property line and it would impact them, they would not be as nice as I am. I did try to go talk to them about it in a nice way.

Where they are putting the tree won't block any neighbors from view due to how their house is at an angle in the cul de sac.
 
I'm interested to know what the HOA says. We planted five trees over the last several years. None were closer than 15 feet from the property line, but they will be large trees when they are mature. It never occurred to me to consult the neighbors on tree choice or placement.
 
Plant a magnolia tree in your yard on their property line.
They make a HUGE mess. ;)

Going to have to. This tree will be planted less than 3 feet from our property. I am worried that the roots may come into my yard and cause problems. The more I think about it, the more I get frustrated.

If this isn't a sturdy tree, with the severe thunderstorms we get, I am afraid this will fall on our house once it is full grown. If so, it would land in my daughters bedroom.

It takes silver oaks 80 years to reach maturity! Not saying you can't have a problem before than, but worrying about roots causing problems or the tree falling over on your house during a storm when it is likely a very small tree at this point seems premature. If they aren't violating the HOA, you are out of luck. I would be thrilled if my neighbors were working on making their property more appealing. You could live next door to slobs who have an Adam's family front yard.

Ah, I have one in my front yard. They've evergreens. They do drop a few leaves and pods in March. Neighbors for 4 houses around me all have evergreen trees too. I spend all fall racking up leaves from the non-evergreen trees from my neighbors trees almost a block away!:rolleyes2

That is a positive way to look at it, but where it is being placed, I think it is going to look rather odd. It is going to be next to a Crepe Myrtle they already have and off to the side. If they moved it down and over about 8 feet from where they are planning on planting it, I think it would be lovely.

Now the little I have read says it is a fast growing tree. Though I haven't found how much this actually is. Thanks for sharing the information about the roots.

Maple trees here ar the worst for that- we had one fall in our yard from the neighbors yard and another one in the front had its roots crush our sewer line - luckily it was on the little 2 foot patch that was the towns so they had to pay to fix pipes and redo our finished basement (it backed up into there!)

We are only allowed to have Bermuda grass in our yard per HOA rules. So this doesn't grow well in the shade.

I would have more of an issue with someone telling me what kind of grass I could plant than a tree!! Wow-talk about micro-managing!!!! That HOA needs to get a life!

My friends mom is 90 years old- her neighbors rake up the leaves from her tree that fall into their yard into a garbage pail and dump them back over the fence into her yard!!!! I've always been lucky, my neighbor that has a tree comes over and rakes up all his leaves that fall into my front yard for us!
 
Thanks. I was thinking that. I do know they are supposed to get HOA approval to change up the landscaping, not sure they got this approved.

Just hate that it makes that we have bare spots in our yard due to their tree shading our yard.

You don't know that you will. Scotts sells grass seed especially formulated for places that are mainly shade.

We have big Oaks in our front yard and not a bare spot to be had.
 
Sounds like you need to move. If things your neighbor does legally in their own yard bother you so much, move where you'll have plenty of land.

Or learn to live with people.

:worship::worship: LOL I grovel at your feet. WOW this sounds so anal to me. Stressing over what MIGHT happen in 40 years.

LOL, that's one good thing about growing up and living in a major city (NYC) if you flip over the color Christmas lights your neighbor hangs or what type of tree she plants you'd never last.

Op, I would take a deep breath and not "borrow" trouble as my mom use to say. I think telling the neighbors what type of tree they can plant and/or siccing the HOA on them is not going to endear you to them and they are your neighbors.

Does the seed work on Bermuda? Have you used it? If so, I would am interested in hearing if it works. I am willing to give it a try. Need for the bare spots the neighbors Crepe Myrtle is currently creating.
