Neighbor planting tree near property border. Update #72 problem solved

:worship::worship: LOL I grovel at your feet. WOW this sounds so anal to me. Stressing over what MIGHT happen in 40 years.

LOL, that's one good thing about growing up and living in a major city (NYC) if you flip over the color Christmas lights your neighbor hangs or what type of tree she plants you'd never last.

Op, I would take a deep breath and not "borrow" trouble as my mom use to say. I think telling the neighbors what type of tree they can plant and/or siccing the HOA on them is not going to endear you to them and they are your neighbors.

I totally understand what you are saying. From what the neighbors told me this is a fast growing tree. My Japanese Cryptomeria in my backyard grew to over 30 feet in 8 years. So I am wondering if this fast growing Oak will do the same?

This is not the first issue I have had with these neighbors, as I stated in an earlier post, when they had trees taken down in their yard, trees in my yard were damaged due to the falling trees landing on mine. These folks didn't even apologize, in fact when I asked if they knew what happened they denied everything.

Also there are other issues that have occurred but don't relate to this current tree issue.

Not going to sic the HOA on them per se, but going to see if there is any rule on how close to the property line that trees can be planted if they are going to be large trees.
 
Interesting thread. I can see being annoyed, but I have to be honest, I'd be a whole lot more annoyed if a HOA told me what I could or could not do in my yard, whether it be trees or what type of grass. But, of course I realize those type of restrictions have to be disclosed before you buy.

This is my basic reaction too. It's my property, I should be able to do what I want with it. :confused3
 
We are only allowed to have Bermuda grass in our yard per HOA rules. So this doesn't grow well in the shade.

So buy a bag of Bermuda grass seed....dump it out and replace it with a shade grass...make sure you leave some in the Bermuda bag and leave it in your garage...when the HOA police show up on your doorstep to yell at you for planting the wrong grass...show them the bag and say...this is what I planted...

That suggestion made me laugh and it is very tempting. When we bought in this neighborhood we knew that we would have to follow the HOA covenants which states you must have Bermuda grass (which the builder installed on all properties) and if you make any changes to any of the landscaping it had to be approved. Like I stated before, most do get approved except for the grass.

The tree they are going to plant looks pretty. It is sitting in their side yard. It is about 6 feet tall right now, but it looks more like a maple than an oak, but I am no expert.
 
It's just a tree! In their yard! Not sure what all the outrage is about. If I want a tree in my yard ill plant one. No way would I ask my neighbors permission. I can't imagine living next to someone who would make such a big deal over a tree. I love trees, shade, and privacy. And the more trees the less I have to see my neighbors. Maybe that's why they want it.

It is in the HOA covenants that if you change landscaping in your yard, you have to submit a plan. Most get approved.



Yes, the tree will be in their yard, but it will impact MY yard due to how close to the property line it is being planted. It will shade the grass in my yard, thus the Bermuda that I am required to have in my yard won't grow.

When the leaves fall, and if this tree has those other growth things on it that sheds, I get to clean up the mess also. I did not ask for this.

Now if I planted something like that near the property line and it would impact them, they would not be as nice as I am. I did try to go talk to them about it in a nice way.

Where they are putting the tree won't block any neighbors from view due to how their house is at an angle in the cul de sac

So what *might* happen to your yard trumps what they want in THEIR yard? I don't think so. You seem to think that you should have reign over your yard and their yard. That is not how it works. If you have a problem with the grass IN YOUR YARD take it up with the HOA. What kind of HOA tells you what kind of grass to plant? That is even more absurd than your reasons for wanting your neighbors to not have a tree.If any neighbor tried to put up a stink over me planting a tree, I'd find out what trees or shrubs are permitted and make a big natural fence between the yards.
 
Plant a magnolia tree in your yard on their property line.
They make a HUGE mess. ;)

Never said I didn't want them to have the tree. Actually, if they move it over a bit (hasn't been planted yet) it wouldn't bother me a bit. In my last post I even stated it was a pretty tree.

Not a fan of Bermuda grass, but when we bought here we knew this was in the covenants and new we had no choice. I would rather have fescue.
 
Walked out my front door a few minutes ago to put a letter inmailbox. To my surprise there is a T190 Bobcat and a commercial type lawnmower sitting in the middle of MY front yard.

Magnolias are gorgeous trees. There are some in the older part of town that are huge.

Tell them to move it to their front yard. Those things can dig the lawn up.

Yup. And if they're not rentals (so there's a landscape company there), I'd have words with the landscape company for parking it on your lawn.

I suggest she call the HOA and the police. Personally I don't think this is going to get resolved nicely. OP is determined that this tree will cause her problems so really doubt that it won't escalate.
I can't imagine any landscape company parking equipment in the middle of some one elses property for the simply fact they know they would be liable for any damage. Now it does sound like the neighbor would do that (If it's a rental) because they seem to have a history. If that's the case, you want to complain to the HOA, file a grievance and have the police there to make a report.

Sounds to me she doesn't want the tree so any thing and every thing associated with the tree is going to be a problem.

Op call HOA and police and be done with it. I can already tell this is not going to end well.

Okay, I was with the folks wondering what's the big deal about a tree, and figuring it must have to do past history with these neighbors.

Now I understand! It's not the tree, it's that you know for a fact that they are inconsiderate idiots who will not hesitate to take liberties with YOUR yard in pursuit of their goals.

Get out there and start hollering to get those things out of YOUR yard. The nerve!
 
Asked landscape folks to move equipment. They were very nice and apologized. Man I spoke with said neighbor told him it was okay to park there and we wouldn't mind.

Let me make myself clear, I admit I don't want the tree in that particular spot. If they would move it over 5 feet, I would not be concerned at all.

Just go to the landscaper and tell him to move the tree over 5 feet and that the owners won't mind.
