LOL I grovel at your feet. WOW this sounds so anal to me. Stressing over what MIGHT happen in 40 years.
LOL, that's one good thing about growing up and living in a major city (NYC) if you flip over the color Christmas lights your neighbor hangs or what type of tree she plants you'd never last.
Op, I would take a deep breath and not "borrow" trouble as my mom use to say. I think telling the neighbors what type of tree they can plant and/or siccing the HOA on them is not going to endear you to them and they are your neighbors.
I totally understand what you are saying. From what the neighbors told me this is a fast growing tree. My Japanese Cryptomeria in my backyard grew to over 30 feet in 8 years. So I am wondering if this fast growing Oak will do the same?
This is not the first issue I have had with these neighbors, as I stated in an earlier post, when they had trees taken down in their yard, trees in my yard were damaged due to the falling trees landing on mine. These folks didn't even apologize, in fact when I asked if they knew what happened they denied everything.
Also there are other issues that have occurred but don't relate to this current tree issue.
Not going to sic the HOA on them per se, but going to see if there is any rule on how close to the property line that trees can be planted if they are going to be large trees.
