my MIL fell at disney

krismom- .. I think I would be almost more angry how the first CM handled the situation then the broken glass itself!! Hope she got the correct training.
I dont think (at least I'd hope) people go to parks looking for accidents where a person could sue, but when something bad happens to you I think its natural to think how it could be avoided, after all thats how problems are solved. Am I upset this happen YES, and i'm glad its being investigated for future guests, but still poop happens.

First of all, I'm so sorry to hear that this happened - the injury as well as the impact on your trip..

Just thought you might like to know that I tripped/fell off of that exact same curb (at night) when I was at Disney last year.. Fortunately, I wasn't hurt - but it's definitely poorly designed - considering the parks are open at night and the lighting is next to none..

Also, I wasn't watching anyone waving - just walking along.. Guess the best thing to do is for everyone to walk through the parks with their heads down - watching every move their feet make - paying absolutely no attention to the beauty that is surrounding them..:confused3
 
I'm sorry to hear that your mom got hurt, but it seems like she got good care and is on her way home to her own bed. A positive attitude and family to take care of you is a good way to recover.


The reality of life is that nothing is perfect and there are 'dangers' everywhere. But it doesn't matter that X+ thousands of people have walked that same route daily for who knows how long. Things happen.

But it does sometimes take a few incidents to occur before changes are made. However, we can't people proof the world. Life would be no fun. Also, you can't live with your head looking down -- you'll miss so many things (like that tree you're about to walk in to!)

I got injured on our first WDW trip and they voluteered to give me compensation. I suspect that is what will happen in this case, as well.

This happened back in 1991. My DH and I were staying at CBR. It was the last night of our vacation (thankfully) and we were walking down a stairway to go to the pool. I ended up missing the last step and twisting my ankle. We looked around to figure out what happened and we noticed that the light bulb at the bottom of the stairway was burned out.

I hobbled back up to our room and called the manager to let him know what happened and advise him about the burned out bulb. He said he would come to our room to take a report. I said that wasn't necessary, we just wanted them to fix the light bulb but he insisted that he had to come up. He brought and ice pack and an extra pillow. He filled out an accident report form and said he would be submitting it to the claims department. I said that wasn't necessary but he said he was required to do it. He asked if we needed a ride to the hospital and I said no, we were flying home the next morning and I would get medical attention there if I thought I needed it (it wasn't hurting that badly...yet).

My ankle swelled a lot overnight and was very painful. I was able to make it home and had it looked at that evening. I ended up having a torn ligament and had to wear a cast for 3 weeks.

A very nice claims representative contacted me within a day or two. She checked in with me every week or so until my ankle was healed. She asked me to send copies of my medical bills, which I did. WDW ended up offering me $2000 to settle the case. This covered all of the bills and then some. I didn't ask for a settlement, they offered it. I did have to sign a form saying that the case was closed and I wouldn't seek further payment.

The whole thing was handled very well from WDW's side. They were very kind and professional. I hope your mother-in-law gets the same treatment.:)

you poor thing!! That sounds painful to even read!!
I would be satified if my mil's hospital bills were handled , if nothing else. But i'm also glad they are going to look into the levels of lighting in that area.
Luckily , my mil is retired so she isnt missing any work , as horrible as it is to say i'm glad it wasnt my mom who feel. She still needs to work. So far the claims woman has been very friendly, checking up on her and such. My DH is going to handle the rest for her through the woman , he should get in touch with her tomorrow so i'll let you guys know how it turns out
 

My thoughts exactly! I also take offense to comments by someone who (rather appropriately) calls themself "TheFlame." Members of our prestigious profession worked for years just to get licensed, and most serve honorably, dedicating themselves to their clients. For many, the law was a calling, a way to contribute to society. Countless lawyers will tell you they were inspired by people like John Adams.

Despite common perception, we are not all driving $100,000 cars and living in $1,000,000 homes, either. Many, like me, are drowning in student loan debt, in fact.

Are their bad members in our profession? Absoulutely, just like there are in EVERY profession. But, (at least in Florida) we do an excellent job of policing one another, and are very quick to suspend and disbar those who do not follow the rules. Yet it is the attorneys who are mocked and ridiculed. Guess what -I don't find lawyer jokes funny either -I find them insulting.

Flame, I hope that one day you find yourself in need of a good lawyer and are represented well. Perhaps then you will learn to have the same respect for the profession that I and my colleagues do.

BTW- To the OP, I am glad your MIL is doing well and she can now recover at home. Life throws curve balls, it's all about how prepared we are to go at them and show others how to correctly play the game!:thumbsup2
 
Glad to hear your MIL is doing better. My friend's mother missed the concrete block that is located at the top of a parking spot at AK, fell over it and needed surgery on her hip. My friend was very angry at Disney and ended up staying there for two extra weeks, until her mom was able to return home. My friend was angry with Disney that they didn't pay for her extra 2 week stay, passes for those days and all her mom's medical needs. In the end, her mom is fine and she hasn't returned to Disney since. OP, you seem to have a much better attitude than my friend. I hope your mom continues to improve.

I don't know why Disney wouldn't cover the medical bills, if the acciddent occured on Disney property as a result of negligence on Disney's part (versus human error). I think Disney probably examines these things on a case by casse basis, otherwise they'd be paying for every slip and fall and injury on property, whether it was their fault or not. But, I wouldn't expect Disney to pay for a hotel stay if I chose to stay behind to be with a family member (if I felt the need to stay, there are many other places besides Disney resorts) and especially wouldn't expect theme park passes -honestly, if she was there only to care for her mom, why would she need park passes?
 
My DH stayed back with his mom but stayed in the hospital with her. (came home very stinky because he didnt shower for 3 days) The hospital (floriday hospital in orlando) was very nice and they told DH they knew his situation and got him a cot to sleep on next to her , along with a private room for mil. There was no park going for him but he did have to go back to SOG via taxi to get his and his mothers suitcase.
 
Gibsontrio and Disney1976...I completely agree with you. I also felt she was simply expecting and asking too much of Disney considering her mom wasn't watching where she was going. It was a difficult situation that got much worse because of how she acted.

The same thing happened to my SIL 75 year old aunt last month but it was at POR and it was her shoulder. She was putting on her watch and was not paying attention. She ended up going to the hospital ,flying home the next day and having surgery. She ended up with pins in her shoulder and going to physical therapy.
I know Disney was informed of the accident but she did not ask for anything and nothing was offered.

I trip on that same curb everytime I go in MK. My DD actually said the last time "Are you going to trip this time"?
 
and a black mark on your trip for sure. I hope your mil has a very speedy recovery.
We had our first trip to the World last September and I was really surprised at how dark it is there at night. Very few lights around. I can understand it for the fireworks and whatnot, but truly, I felt it was a little too dark and rather disorienting. Especially if you've never been there before amongst a throng of people.
