My Autistic son got attacked at school today

I never said I would suee anyone. They were negligent because they didnt have proper student teacher ratio something his teacher admitted to me. the teacher was out sick. this sub had been in the class room 2 weeks ago with no issues .the parent is also at fault because she knew her son is having repeated issues. when my son had anger issues i got him help with a behavior therapist and we increased his meds. he has never ever attacked anyone but he has hit himself. he has punched his teacher ( not hard ) because he was upset by something and he could exspress it. michael had done nothing to this kid in fact they have pretty much grown up together being in each school/ class together since they were both 3. all the teacher told me was that mikey ( the other kid ) gets like that when people get noisy and they try and re direct him. so there have been issues before this but i am not sure of what. I dont think they would of suspended him if this was his first time. what is sad is i am not sure if he even knows why he is suspended. what do i want out of this. i want my son to be safe he only has till he is 21 to finish job training. i want a 1 on 1 with him. i want someone to step up to the plate say we screwed up big time this wont happen again and remove the other kid either from the class or the school. i am not saying my son is an angel but he has never attacked a student and when there have been issues i handled them immediatly even removing him from the school untill i was sure he was stable when we increased his maed. thats the right thing to do. everyone failed my son and i want to make sure this dosent happen again. I also want someone to pay for the medical bills if his medicaid dosent pick up the tab which has happened with his reg doctor bills unrelated to this. We have a follow up apt with his ped in 2 days. now i need to get his Er records and his records from the school of the incident if there are any and let the attorney know whats going on. they failed on multiple thing. they didnt even call EMS and he has autism/ epilepsy.i was called to pick him up. his nose continused to blled for 15 mins in the ER after i go t there so 20 mins at school plus a 10 min ride to the ER plus 15 more mins in the Er .. it wasent a fun day!

just a heads up. If you get a 1-1 aide remember to make sure that it is in his IEP that there is provisions for coverage for the 1/2 hour lunch and 15min break that they are required to give the aide.

I do want to prepare you for the fact that the other boy may not get suspended. It is very difficult to suspend a spec. Ed student especially if his actions are a result of his disability. You can request that the other student be removed from the class, but if the district doesn't have another appropriate place for him to go that could take some time to work out.
It does sound like this other student needs a full time one-on-one aid due to his behavior.
 
I am so sorry to hear about what happened to your son. I wish him a speedy recovery!!

I wish I had more insight or words of wisdom to offer you. My son got beat up on the bus by another student with Autism, and it got to the point where there were more aids then students on the bus. Thankfully now the other boy actually lives at the school they go to and my son only shares the bus with a sweet little girl with Autism.

I will keep you all in my thoughts, and wish and hope for the best!

the other kid did get suspended till tuesday. i spoke with 1 attorney who said just get the kid switched out of the class room, now another who wanted to see the pics and meet with us next week. not sure what to do about sending him to school. part of me says keep him home the other part says send him. he started hitting himself earlier and his behavior therapist asked me to ask him why he was doing that. he said he is very angry at mikey for hitting him. so we are going to have him write a letter to Mikey ( not sending it ) so he can get it all out on paper. I hope this will settle him down at least for the time being. We kinda thought this might happen, but hoping that it didnt! I hope no one ever has to go what we are going through..
 
So sorry to hear about the incident with your son, Mike. You're doing the right thing by asking for the school to be held accountable and requesting a revision to his IEP to receive the supervision he needs by a trained aide. I hope he feels better and that he continues to get the appropriate education and care that he needs and deserves. {{Hugs}} to you, Mom!

This is assault. Meet with the principal to detemine how safety for your son can be better handled. (Obviously, there are no safety precautions in place at the moment.)

Schools are NOT battlegrounds. Your son deserves better consideration. Please talk to the principal, then send him back to school ONLY if you are satisfied with the new plan of protection and safety.

The school principal must be shocked. I'm sure you and he/she can come up with a better plan. Good luck to you.

Well I will be hoping all go well for mike Tom if you talk to the teacher and school tell them you want to know from know on when the regular teach not going to be their at least 48 hours in advance. For planed day off and if it emergency or call out you need to be told so you know so you can plan what to do. Please le us know Tom how it goes well as much as you wan and it Ou fell like to share.
 
ok we drove Mike to school today he insisted daddy go too or he wouldnt go so he called into work late TG. We talked to the Assistant principle who happened to be a first responder to his class. this is what he said happend Mike was doing a puzzle and the other mikey was on the computer. my son walked over behind mikeys computer chair and watched what he was doing. the sub teacher Yes Autism trained cleaned up the puzzle and started walking over to bring My son back to help clean up. Thats when she heard mikey ( other boy ) yell STOP and he punched my son.They grabbed my son rushed him to the table and sat him down with paper towels. A therapist came in and grabbed the other boy and pulled him to the ground telling him he is suppose to use his words not his hands. The nurse came in and took mike to the clinic to tend to him and I was called. He said the boy is suspended till tuesday. The mother is keeping him out the entire next week and having him evaluated again ? The school will have a meetine on monday to figue out what they are going to do. He did tell me that mikey will have a shadow with him for his every move . not sure that this makes me feel any safer. I want the kid out of here. He did say that this student was becoming a bigger problem then they could handle so he might have to be transfered out .He wasent sure if he could put him in another class because the other 2 classes werent equiped to handle him if he got out of control again .The other teachers are females Mikey is about 6 foot and 300#. Not sure what will happen now till monday. Michael did have a good first day back seemed happy and told me what he had for lunch lol
 
I am happy to hear that your son went back to school and that his father was able to go in late so that he could help him with that. :)

Wishing you the best of luck with this situation. I totally understand not wanting the other boy back in the classroom and near your son.
 
I would say that you need to speak to someone who specializes in this type of law/issue before you do anything else. Stay calm, seek out experts. You'll obviously be upset, and lots of people will offer opinions, but for anything to happen you absolutely need to go through the right channels. Document everything you can. I think you need to ask your legal counsel a few specific things like what the school is legally obligated to do when a student is hurt, especially to the degree your son was, what the school is legally obligated to have in the classroom in regards to superiors (teachers, aides, subs), if a sub in a special needs classroom is obligated to be trained in how to deal with special needs children, and then what the school's rule regarding these things are.

I am so sorry that this happened to your son. :( The above is good advice. I would hope there would be a safety plan in place for the violent students that the sub would be aware of. Sounds like you have lots of phone calls and follow up to do. I hope your son recovers emotionally and physically quickly.
 
thanks today was better he said he had a dream but he didnt say it was scary .he went willingly on the bus . his teacher said he had a very good day with no signs of agression . he hits himself when angry . but he has gotten better the last few month and is using his words to exspress instead of hit.not sure what will happen when/if the other kid comes back. I will see what happens on monday when the principle, teachers, aides and ESE admins all sit down and have a meeting. When i told the asst principle I wanted mikey ( other kid ) out of my sons class he said he didnt know if he could do that because he wasent farmiluar with the ESE dept and how many classes they had or who could handle such a child. he also said they would concider the child being moved to another school seeing this wasent there first go around. not sure if I mentioned this before or not but I know this boy and his mom. My son and him have been together since they were 3.the Mother has always been VERY passive and this is the result. Mikey didnt get what he wanted so he got agressive this is what he sees at home. Sad in my eyes but I could see this bound to happen. Sadder yet Emotionally I know there is nothing i can do for him . its much harder to deal with this because I told her years ago not to let him get away with thing. never in a million years id i think Mikey would go after my son. my emotions are very raw and I am not getting much sleep. I wished Monday would get here already. Please pray for my son. Emotional dammage is so hard and he cant exspess it but though through hitting himself out of frustraition or writting pics or letters about it. thanks I will keep this updated as long as I can. if someone knows how to bump this up feel free to do so or tell me how

I'm glad he's gone back to school and I will keep all of you in my prayers...
 
the asst principle calld me today to tell me the student would be back in class on thursday and that I needed to move my son out of the class because they could not move the other kid. I said well why not my son did nothing wrong so why should he be punished. My son does very well in that class. they offeredfor Michael to go into another Autism class with a teacher he dosent do well with and that i dont get along with her very well. So I said no thats not going to happen. I said well if you dont want to switch the kids class then move him to another school. he said he didnt have the Authority to do that So i said you know darnw ell you can do anything you wanted to do. I said well i will speak to my husband about this and get back with them. I did not say that i was seeing an attorney on Wednesday because I didnt want to screw anything up. My son is traumatized by this kid and I wont let them come together.I dont like there solution.. so now I am fighting palm beach county school board with one of the best attorneys aound.. to be continued...
