Nah, that pic is way too cute. Those seagulls are some of my favorite Disney critters. Don't taint them! ;)
 
Arrest? No. Keep in a location separate from the OP for the OP's safety and peace of mind, for a period of time until the OP was out of the store and out of the parking lot? Yes - and that, too, is a definition of 'detain'.

I wonder how they could legally detain her, though? Unless they were calling the police and wanting to charge her with something, how could they detain her?

I am not agreeing with sbell and saying I know they didn't, but I really don't know how they could have.

.....you should have taken your cell phone out and posted a pic/video of the event on the 'people of walmart' website...I am almost sure it would have been a number on hit...it may have even gone viral on youtube!!! :surfweb:

I thought a security guard has the power to do this. Otherwise, what good are they!

WalMart (or any other store) is private property and their security officers are there to ensure the safety of their customers and their merchandise. I think if they detain you without just cause, you could probably have a case against them for violation of your 4th amendment rights, but considering the number of witnesses who heard/saw this lady being verbally abusive, I don't think she'd have a snowflake's chance in the eternal bonfire of pulling that one.

Where I work, security can and does detain people all the time. They can hold them until the police show up if they are to be arrested, or they can remove them from the premises if they are just "behaving badly" so to speak without actually breaking a law. I assume (the deadly assume - so I could be wrong) that all security guards had this power. My thoughts are that this lady falls into the "bad behavior" catagory, so they didn't call the cops, just made sure she didn't harm the OP.

See, I can see them detaining her if she committed a crime on their premises until the police arrived. And, I can see them escorting her out of their store, if they do not like her behavior. I just don't see how they could legally detain when they are not calling the police. Of course, I could be wrong.
 
You guys know that WalMart didn't actually detain the woman, right?

I'm sure there must be a point to that statement but, I am at a loss to know what it is. Are you saying that this ladies (term used loosely) right to not be detained overrides the other persons right to be protected from harm?

If so, and if this is a widely held belief, this is going to be a more scary country by the minute. I'm sorry but some of the most hideous situations that arise, get that way because everyone is afraid to do what is right. The concern over individual rights, although important, needs to be weighed against the good of all. We seem to have forgotten that these days.
 
I am sure they didn't even need to detain the crazy lady. She most likely stayed voluntarily to complain to anyone and everyone about how they sold "her" game to someone else!
 
You should have told the lady your ebay ID and that you would be listing it later in the day if she's interested! :rotfl2:
