That article doesn't seem very accurate. We know TLC is not in court to try to get Jon to allow filming of the kids, at least not officially.

I also do not think NC labor laws are more lax than PA. There are no protections for reality show kids, so I wonder why they don't argue that instead of about complying/not complying with child labor laws.

I'm sure you've heard about little Josie Duggar. :guilty: This will certainly affect their filming, so what back up plans does TLC have for difficult issues that families face? I hope they handle it better than the Gosselin demise.

I googled NC child labor law and it *seems* that child actors are exempt (from the labor law as published). In fact there was a specific statement to that effect when it was speaking about children under a certain age not permitted to do anything that is non-agricultural (i.e. working the family farm). I did not do any additional research to find out the scoop on how one gets the exemption or if it simply is just an exemption. I know that NC has lots of filming and that Dawson's Creek was filmed there. But I do not know how much of that is related to it being a filming friendly state in general (or if the Dawson's Creek actors were even minors even though they portrayed minors.)


As for Josie Duggar--my ONLY comment is that on the Little Couple, Jen is a neonatologist. She works in the NICU and at least every other episode has her at her job checking on her patients who are nicu babies. Sometimes with parents present and sometimes not (I would presume that due to HIPAA that consent was provided in some format). They do not show all her patients, but they do show the occasional patient. That show is filmed in Texas.

NC has no restrictions for child actors and models aside from filing a work permit. They are exempt from all child labor laws. That is part of the reason the state has a huge film industry. Lots of movies with kids are filmed in NC because it's easy. NC also offer incentives like tax breaks, expense reimbursements, etc. Firestarter, Richie Rich, Secret Life of Bees, on and on...all have minors as actors, and filming was able to be done quickly using long hours. Reality show kids, aren't considered to be working (like you said) so laws (or lack of) are a moot point. Their production company (the Gosselins') Figure 8 films, is in the triangle area of NC.
 
Thank you. I couldn't find it when I did a search. I thought I saw that somewhere. I see that it says she appeals..I thought I read it pretty good..did it say somewhere in all the remarks that she lost the appeal? I assume she did, but I didn't see that.

That was the appeal hearing, which she lost. Medicaid has fairly strict guidelines (protecting all our tax dollars)and only covers a trained nurse for premies for as long as it is medically necessary. The kids were all healthy -- as the parents admitted -- and Medicaid funded nurse was not needed.

I did a quick search and also found this. It is a bit snippy, but cites Angela Krall, the nurse in question speaking to US Magazine.

Coming out of lurkdom as well to ask...how many would actually watch Kate and her new talk show? I don't think she could hold my interest long enough, but that's just me. Both Kate and Jon's 15 minutes of fame are up if you ask me. (But, no one has ;) )

I won't watch, but I think there are quite a few who will!
 
Here is an AP report from 2005 regarding the baby nurse. Kate appealed the Medicaid cut-off (automatic after one year if the children are healthy) at a hearing and her appeal was denied.

TLC/Discovery getting a temporary injunction against Jon was quite predictable, I think. The contract seems to include language that the Judge decided was binding giving TLC exclusive rights to his TV appearances through May, whether or not they are paying him. Jon really needs to dust off his IT resume quickly, or try to get a job at McDonald's!

Of more interest to me is the countersuit, but we will have to wait until April for that. It seems that TLC/the Gosselins have admitted to failing to get location permits for filming, and have not provided the Department of Labor with a copy of the contract although it has been requested. They want the Dept of Labor to get a court injunction for the contract -- so much for their claims of full and voluntary cooperation with the State.:sad2:

I'm not a talk show fan so I would not be a viewer but the idea of a show having Kate do different jobs would be interesting. I hope they do McDonald's.... that would be funny
 
If Jon and Kate started filming about themselves, at least they would get a paycheck from TLC. Right now, it is better than no money and being under contract and not allowed to work anywhere.

No problem with either of them getting a show - as long as the kids aren't involved and the parents don't use it for a platform to snipe at each other..

However, I don't see either of them having a big enough following for a show to remain on air for more than a month or two..

I think it's time to look for "real" jobs in the "real" world so they can support their children together..

I'm like you, not a fan of talk shows, but this sounds like it could be fun. I would at least start out watching it.

My thoughts exactly! Growing up, as well as when my children were growing up, we knew several families with 10,11,12 children (think Irish Catholic neighborhood). I knew the families and there was many more I did not know - large families were not a big deal. Most of the time fathers worked and mothers stayed home - most moms would find a part time job when the youngest went to kindergarten. Were they rich? Nope, comfortable - seemed so and they were happy - just regular families meeting the challenges of daily life. I have 2 uncles with 7 kids - one has 2 sets of twins. Funny, they did not have a reality show and all of the kids went to college and have families of their own now, still all close knit. I was an only child and loved spending time at their houses - it was so much fun.

Honestly do not understand why these parents think the only way to support their children is by having a reality show. There is another show on - is it Table for 12? The dad is a police officer, mom stays home and they cared for the family just fine before TLC came along.

I know I'm rambling....:rotfl:Have nothing against Jon & Kate, but tired of hearing their complaints about how will they support their children without a reality show. It can be done and is being done by many families we will never hear about. And, lots of large families have multiplies as well.

I just left watching The Blind Side in the same theater as Jon Gosselin and his latest chick, in Park City, Ut. Skiing is not great today.

Jon & Kate, Table of 12 & the rest are looking for that big pay off. They want to be stars. It is like the guy who pays the lotto every day hoping for that big break in his life. It all comes with a price

It sounds like money is tight for former reality dad Jon Gosselin.

Last week, TLC was granted a preliminary injunction that forced Jon to stop making public appearances. Now a source close to Gosselin tells Fox411.com that the decision was a serious blow to the livelihood of the former “Jon and Kate Plus 8” star.

"Jon's in pretty serious financial trouble because his plan for making money was shut down in court,” the insider said. “He has warned his lawyers that he can't pay them and if he doesn't succeed against TLC, he will have no funds. He's even gone so far as to say that if they want to be paid, they will have to sue him."

Those lawyers are part of a father/son team that was introduced to Gosselin by Michael Lohan, says the insider.

"Mark and Mike Heller were brought in because Michael Lohan was involved, and he convinced them to join Jon's team early on in the summer,” the source said. “Lohan wanted to latch onto Jon and involved many people he knew. He convinced them Jon was going to have a successful career after the show.”

Mike Heller is the CEO of Talent Resources, which manages Jon Gosselin, and Mark Heller is Jon Gosselin’s New York lawyer.

But it wasn’t just Michael Lohan,
currently having trouble himself, fueling the enthusiasm around the TV dad. Gosselin also led his lawyers to believe that he had money in his various accounts, said the source.

Now Gosselin's bills are stacking up and he needs to get a legitimate job, but the insider says he is making no effort to get one.

"It's a good thing Kate Gosselin has been put in charge of the family funds that provide for the couple's eight children," the insider says. "She is the responsible parent."

Reps for the Hellers deny any problems with Gosselin.

“Jon Gosselin’s New York lawyer has the highest regard for Jon Gosselin and will continue to work for Jon for as long as he requires their services," the rep said in a written statement to Fox411.com "The Hellers have no concern relevant to being paid by Jon for their services and see no circumstances under which they would ever sue Jon."

“This past year, Jon Gosselin was the most photographed man in America and appeared in more magazines than any other reality TV star," the statement continues. "Wherever he goes, there is an outpouring of love for him from his fans. And there is no doubt that he has a bright and shining career ahead of him.”

There are only a few states that a spouse can get alimony & PA is not one of them.

Do you think the NC move would/could be done since Kate has "primary" custody? Doesn't that mean it's like 60/40 or a split that favors Kate? Wouldn't she then be able to make those kinds of choices (moving, filming, ect) being the "primary" caregiver??

My gut tells me Jon agreed to the Kate having primary custody, it gives him so much more freedom. I do not think it means she got a 60/40 split....but I would not be surprised if she was favored. He might have agreed to it if he was having trouble paying back the money he owed.
