Here are the mitigators in the retrial (different from 2013's trial):

1. Arias has no prior criminal history.
2. Arias was 27 years old when she killed Travis Alexander.
3. Arias is remorseful for killing Alexander.
4. Arias suffered physical and emotional abuse as a child.
5. Arias suffered physical and emotional abuse during her relationship with Travis Alexander.
6. The abusive nature of the relationship caused Arias to suffer extreme emotional stress at the time she killed Alexander.
7. Arias has been diagnosed with Post-Traumatic Stress Disorder.
8. Arias has been diagnosed with Borderline Personality Disorder.
9. Arias’s psychological makeup impaired her ability to cope with the tumultuous relationship she had with Travis Alexander.

Jury is on lunch break but now Nurmi is arguing that Martinez inserted a prior bad act into his opening where no notice was given. Nurmi argues that the state says Arias has no criminal history but intimates that lying to the police is a crime. Martinez says it IS a crime to lie to the police. Nurmi says he was supposed to receive in writing any prior bad act that the state intends to use. Judge denies the motion for a mistrial.

I'd drive the point of her lying about not being there/2 ninjas stories along with the gas cans and removing license plates to show just how premeditated and downright devious she was when she carried out this planned murder.

I see they've called Melendez, the tech that retrieved the deleted photos. It sounds like they're having to back all the way up for this jury despite the conviction. Could be a very long penalty phase.

Love JM's comment about soldiers going to war at 18 and Jodi was NINE YEARS older than that. I think that using her age as a mitigating factor just makes it obvious that they're reaching...this isn't juvie for heaven's sake.

Also think it's funny that the defense is using the Borderline Personality Disorder as a mitigating factor when Wilmott almost gave herself a nosebleed bickering with DeMarte about her findings of BPD.

We try to make sure he's using a heavier fork/spoon/cup coz 6 months ago when we took him to the doctor that was his main complaint, food wasn't hitting the right spot. He only shakes when he gets irritated or aggravated at something so it's not constant. Thankfully, it hasn't progressed much.

I went out to lunch with my DD and her friends one day and a friend she's known since K had very shaky hands. I asked DD why and she didn't know, but said she's been like that for years. That's got to be tough to deal with!

We are having a good time! Lots of togetherness! LOL DH is working at the moment. Oh well...gives me time to unwind. If I unwind too much tho I'm not going to want to go back for illuminations!
