Because he got scared? He was inebriated and not thinking straight? I'm not saying what he did was right, but I'm reserving judgement until more facts come out.
 
We don't even know that there's been a crime or that there is even any "he" involved. It could be this woman just got stupid drunk, got naked and passed out. It's entirely in the realm of possibility that is all that happened. People do dumb things under the influence of alcohol pretty regularly. A condem nearby could simply mean someone else did something stupid. If a man was found stupid drunk and naked in the bushes people would assume he was just well, stupid drunk.

I'm pretty sure the girl knows if she had sex not. Consenual or not.
 

The two can not be compared. First, we don't know if this is rape because we don't know the entire situation. If this lady was forced and she was fighting him off or passed out I would say it is rape.

I wonder why a person who just committed rape would leave a used condom behind, which would contain the DNA evidence needed to show his guilt. It just doesn't make sense to me but I suppose there is a lot about all of this none of us will know or understand.

In his mind it may not have been rape so he tossed the condom behind. While there are scumbag, stalker type rapists that exist, I think it is even more common to have a decent guy who drinks too much and the evening gets out of hand. Maybe she murmured no, but he didn't hear her. Maybe she was silent and in and out of consciousness and he didn't even notice. It doesn't make it right, but it is difficult when both people are that wasted. Now, if he slipped her something in the bar, toss him in prison and throw away the key!

The football players at Vanderbilt tested the "I was too drunk myself to know what I was doing" theory. They carried a completely passed out girl right past the security cameras and into their dorm room. They dropped her in the hallway at one point and she was out cold. They went into the dorm for thirty minutes where they did the unimaginable and recorded it on their cell phones. When one guy took the stand, he said he would never behave like that, but he said when he saw the video himself, he knew he did. He said he was shocked by his actions on the video. He claimed he didn't remember it at all. I don't know how true that is. If you are talking to friends, able to use your cell phone to record and send the video to others, and you are able to rape a girl, it seems like you might remember a little of that. Was he drunk enough that he actually thought that what he was doing wasn't wrong? I like the drunk driving example. Too drunk to know you shouldn't have been driving? Too bad. He was found guilty of rape.

One more story. DH is friends with a couple that he has known since college. The couple met at a bar and both drank way too much that evening. They woke up the next morning and neither one of them remembered what happened. They were both naked so one can assume. The female was very embarrassed. She wasn't one to sleep with someone she just met and the fact that she didn't remember any of it just added to her embarrassment. They married after college and have been together ever since. So, yeah, sometimes both parties truly are so wasted that they don't know what even happened.

She said she didn't remember what happened, but I didn't read that she denied having sex. She may just not remember the encounter. I'd think she would know if she had sex the next morning even if she doesn't remember doing it.

The fact he was booked means there is SOMETHING that makes them think this was a consent issue, they have to have probable cause to arrest him first. That info probably won't be release while they are investigating but they obviously think there was something wrong.
If they didn't they would continue to investigate until they had cause to believe it did happen so just because we don't know yet what they evidence is does not mean they don't have it.

I tell you what I don't think is rape. I don't think a lady and a guy getting wicked wasted and they both have a feel good moment and the guy is under the impression she wants it. She isn't resisting at all and is even participating. Then the next morning she doesn't really remember anything, but cries rape. This is what I don't considered rape.

Wow! Where did you get all of that from?? Absolutely none of us have a clue what happened at this point. As for her "crying rape" unless the story has changed, she was found naked and disoriented in the bushes by security. She didn't seek help. She didn't jump up and yell rape! She specifically said she didn't know what happened. When the police find a woman naked with no memory of how she got there, they have to investigate. What did you expect them to do? Gather up her clothes, give her a pat on the back, a couple bucks for a cab, and tell her to have a good day? This happened last week Thursday. From what I can tell, the police didn't release any information on this case until five days after it happened. I'm going to assume that they did their due diligence and their investigation led them to believe she was raped.

I know this has been explained to everyone before, but the fact is rape requires "insertion", and the fact that she was drunk and/or drugged means she cannot consent. Even if she willingly took the drugs or had the drinks. She's not crying rape, the law is saying it is rape. I'm sure she was taken to a hospital where she was examined.
