I was wondering if anyone can give me a clue on this?

It's been awhile sicne we've posted on here but here is my question.
I am planning on calling DVC to see what we can do but I'd like to see if anyone has had any experience with a similar situation.
My DH got sick roughly 3 years ago, couldn't work during the illness and insurance and my paycheck didn't cover all of our bills. We filed CH11. I informed DVC that we couldn't pay on our contracts. Now that everything is back to normal and we're back on our feet both financially and health wise what do you think our chances are of getting our contracts back up to date with DVC?
My bet is they will say you are out of luck. I can still login in to our DVC account online and the contract numbers are still there they jsut list them as needing attention.
Keep in mind here I have not contacted DVC as of yet but I am going to do so this week. Any help would be appreciated.
 
Please don't take this the wrong way---I think you need to call a bankruptcy attorney. MS will likely tell you the same thing. All you're going to get from this thread is internet lawyering . . . which won't help you at all. If you previously filed for bankruptcy, the DVC contract may not be yours anymore even if you can still log into your account online.

Our CH13 (Not CH11 sorry typo in my first post) is paid and discharged.
Our lawyer said DVC made no claims and he received no requestes from them. He also checked the Florida (I'm probably saying this wrong) land owners registry and we are still listed as deed owners. DVC made no court proceedings to foreclose on the deeds as well.
You are probably right though on the internet lawyering comment though. ;)

If Disney didn't take action against you and all they did was freeze your account, paying your back loan payments and dues may put your account in good standing. You should call member accounting and see what they say.

I am not sure what orders were actually entered in your bankruptcy but before calling Disney, you should call your prior lawyer and ask his advice including finding out impact of any final bankruptcy orders on anything you may have owed Disney at the time because of its failure to make a claim (for example, you might no longer owe Disney any of that amount owed at the time and Disney may be barred from ever getting it back). If Disney has not foreclosed you then need to talk to member accounting and see about paying whatever is actually owed.

Exactly, assuming there's no loan. They may even be willing to work with you for reduced fees since they would have taken the points and rented them out. If there's a loan, it will complicate things a mite. You should also talk to your bankruptcy attorney to make sure you know where you stand on that end. My guess, and it's only a guess, is they'll agree to bring you up to date for about half what you would have paid in the interim using the points. Let us know what ends up happening as I truthfully don't recall a similar situation.

But it's good news. We worked out what our back payments were, DVC gave us a bit of a break, we sent them a bank check, made our annual dues payment and we are back in business. AND they reinstated our points from last year. Thank you all so much for all of the support, good wishes and info.

August 15th can't come fast enough now. :banana:

Glad to hear it worked out for you and DVC!

It is interesting to me that DVC took their time about ending your relationship. In the long run it was probably beneficial to them as they retained a customer who eventually continues to use their product and make payments to them.

Did you keep in touch with them, or just stop sending money when you couldn't meet your obligations?

And, you said 3 years ago you had some problems. How long was your loan in actual default?

I am asking these questions because they may be of help to someone else who is going through something similar.
