Yes...I know it is not a good idea to buy tickets from someone who is not a reputable ticket dealer. This person had almost 100% positive feedback when I placed my bid on about $450 worth of tickets.

The seller said in the payment instructions, if paypal was desired that I should request a total and an invoice would be sent. I did that 9/3 and still no word from them. Since then another buyer has listed some negative feedback. They stated they sent the money for $500 worth of tickets and never received them.

The good news is that I haven't paid yet. However, I'm not quite sure what my next step should be. Please help.

My understanding of Ebay and retail sales in general is that it's the seller's responsibility to invoice YOU. How is it the buyer's responsibility to have to Ask for the invoice? Since it's only been 3 days since you emailed them, I would email them again and mention that you are worried since 1 - you haven't heard from them and 2 - you see that they received some negative feedback regarding the same type of transaction that you entered into (tickets).

By the time a week has passed from the auction end, if you haven't heard a word from them I would take steps to make sure that Ebay does not hold you accountable for the binding acution agreement to buy. Ebay may have a 10 day waiting period from the time of auction end for filing this type of dispute, not sure.

You can go to the following page on Ebay and file a dispute claim.

http://pages.ebay.com/securitycenter/index.html

From the selection menus, choose:
1 - Report problems with other Ebay members.
2 - Problems with sellers.
3 - Seller won't contact you or sell you item (you haven't paid).

It'll take you to a Help/Information page. To get to the complaint form, click the "Show" link next to the Additional Information header further down. This will take you to an actual form you can fill out with all of your details. Be sure you click the little check box that says send you a copy to your own email.

They also have a process to file a complaint against the seller if you paid but the item was not received or not as described but that doesn't quite fit your situation here.

HTH - GL & lots of PD, :wizard:

9/3???? September of last year? Or is that 7-3? Did you email them from the auction site? I had someone say they emailed me twice from my auction site and I did not receive either email. I would try to email again if it's only been 3 days.

Yes, you are correct. The date is July 3rd not September (time of our trip). I did email the seller and as of yet there has been no further response. The negative feedback from the previous buyer was from an auction that ended on June 23rd.

My own rule which I offer to everyone.

If relevant negative feedback appears in the seller's file between the time you bid and the time you are asked for payment, you may refuse to send payment until after the merchandise is delivered. Send the seller an email to let him know what you are doing.

While refusing to complete a purchase is against ebay's rules, if you have convincing reason to believe the seller may take your money and not deliver the goods you may prevent that by not paying first.

(7/7/05) Big Oops!
I should have chosen much different words.

"My own rule which I offer to everyone.

"If relevant negative feedback appears in the seller's file between the time you bid and the time you are asked for payment, you can for all intents and purposes call off the sale if you choose. You would write the seller, explain that recent negative feedback in his file makes you uneasy about sending payment in advance of receiving the goods and that you would never had bid had you seen that negative feedback. Since the seller would never (What, never? Well, hardly ever!) send the goods first, the deal dies.

"Refusing to complete a purchase is against eBay's rules. But if you have convincing reason to believe the seller may take your money and not deliver the goods, and for that reason you refuse to send payment first, what can eBay say?"

I'm sorry but when you bid you are abidding to the sellers' terms. If you do as suggested above then you may have breach the agreement.

Negative feedback can be true or a fabrication of the truth. It also has nothing to do with you and your contract with the seller. Also, eBay may have an inquiry open about this other transaction and a mutual agreement maybe in the works.

If you want to cancel the agreement with the seller, than contact the seller and do so. Just note, that you may receive negative feedback from the seller as well as, you can leave NFB for them.

What do you mean your "own rule"? Did you just make that up? I have never read of this on Ebay itself. As a seller there is no way in tarnation I would be shipping out something that got an ending big of somewhere in the neighborhood of $500 without receiving payment first. They then have the item and no inducement to pay.

I agree with that 100% I would never mail out anything without payment first!!!

Maybe one of the more eBay savvy can come in and expand on what I'm about to toss out there . . . but wouldn't it be possible to back out of the bid (going through eBay of course) since technically tickets aren't supposed to be resold?

If this person isn't an authorized seller of Disney tix, wouldn't the seller be in breach of eBay's rules and therefore give her a loophole to back out of the transaction if she wanted to?

This will sound bad, but I'd back out on the auction. $450 is a lot of money (to me anyway), and ebay Disney tickets are very dangerous -- even more so when you consider that this person now has such a suspicious negative attached to his/her name. If the tickets turn out to be bad, you have very little chance of ever seeing a penny of the money back. I'd take the negative on my ebay rating to save $450.

Because You Are Spending So Much Money, I Would Request The Phone Number Of The Seller & Call Him.

Explain Your Feelings, & Find Out What The Negivtive Is All About.

If You Don't Feel Comfortable About It, Email Safeharbor, & Explain. Better Yet, Go To Live Help, & Ask Them What You Should Do.

Hope This Helps.

I have an ebay oops of my own. I have over 900 feedbacks so needless to say I have been around for awhile. So anyhow I bid on something last night without checking out the payment options first. I won the auction only to find out that the guy only accepts bidpay, so fine no problem. I e-mail him to find out if he will invoice me or what since I have never used bidpay. He writes me back and tells me that he has a similiar item listed at amazon.com that is close to the same price I paid ($10 more) and that if I will just buy that item then he will invoice me. What???? He wants me to buy something he has listed on amazon in order to invoice me for something on ebay??? This is way to weird for my taste and bottom line is I won't be paying!!! If he wants to leave me a neg. then so be it. I'd rather get a neg. than loose my money which is what I see happening here.

How much time lapse was there on the auction that generated the negative feedback? There seem to be a lot of short fuses on eBay these days and people are leaving feedback without checking for delays in the Mail or other shipping methods. If you decide to back out of the transaction, "going through eBay" isn't going to make any difference that I know of; they are way too big now to really care who does what on an everyday basis.

As to the bidpay problem, just go to bidpay.com and follow their instructions. It's fairly easy.

I wouldn't pay. Take the negative and move on. I would never buy Disney tickets on Ebay as the risk is just too great. Go through Mousesavers newletter and order them from one of their sources. It may cost a little more, but it's worth it for peace of mind.

Bidpay is not the problem. i was going to do that last night but I'm glad I checked my e-mail first because the guy told me he needed me to go to amazon and buy his other item and then pay him through that link. He has 0 feedback and I always like to give people the benefit of the doubt but this was a $280 item the item on amazon is $289.99 I can't put that much trust in this guy who seems to be up to something :smooth: .

I think this is sound advice. Send an email to the seller with an explaination. And- you might not even get a neg. you never know.

I never bid on things where there is 0 feedback. Especially something for $280.00, I would definately watch that in the future.

I don't either and I debated doing it and then just thought okay I'll take a chance everyone has to start somewhere and if no one had been willing to take a chance on me then I wouldn't be wher I am today with ebay, well you can see where that got me. Oh well I guess it was my stupid move for the year  at least I didn't pay him.

The negative feedback the seller received was from an auction ending June 24th and was listed on July 3rd. The seller's response to the complaint on ebay was " Have emailed multiple times. Tickets shipped v usps and I'm working on tracking."

I am apprehensive about paying for this until the negative is resolve. If I miss out on a good deal...so be it. I am not thrilled about getting a negative feedback either. At least I won't be short $450.

Wow that is a pretty quick negative but the I'm working on tracking sounds funny too (didn't they send such an expensive item via delivery confirm at least?!?)

I would simply send an e-mail to the seller stating that you would be more than happy to pay for your auction once feedback has been posted by the other party stating that the situation has been resolved or they give you the tracking number so you can check that the item was mailed to the buyer!
