Is it possible to give my contract to someone without Disney having first right of refusal? Would there be closing costs involved ?
 
I'm not sure how it would work, but we were told that we could give our membership away and it would just be a matter of changing names and addresses. But I think it had to be a family member

Right of Refusal is required whenever a transfer of ownership is done. Disney will normally pass when the gift is to an immediate family member. There will be costs to register the new deed with the county.
 
Doc's advice sounds excellent (as usual) but why not call DVC administration and run it by them? It can't hurt. Echoing Doc's post, closing costs are a county thing and not controlled by Disney, so I would expect to pay something there.

Thanks ;we are in the "thinking about gift" stage right now. I dont want Disney to claim the deed because they have the ROFR.

As long as it's truly a gift, you should have little difficulty. DVC can advise what you'll need to do to transfer ownership. Closing costs, to record the new deed, should be a nominal expense.
 
Doc is absolutely right. I had a conversation with DVC since I will be re-titling my ownership into a trust. You still have to go through ROFR but they will pass on gifts and name changes.

We gave some points to my parents. I faxed the request to DVC for a waiver of the right of refusal since it was a gift to family and Disney sent me a waiver on it. Then we did a Quit claim deed ourselves. Total cost was around $50.00 to file everything. Here's an old thread that helped me do this:

I called Orange County and they were very helpful when I double checked with them on the exact dollar amount to send to file the Quit Claim deed.
