Florida Residency - Military Spouses

Okay, I know there was already a thread about this today, and I read through it. I also read through Cheshire Figment's sticky at the top on tickets, and couldn't find an answer to this question.

Let me state at the beginning, I am NOT looking to get around Disney's policy in any way. If they won't accept this, I will happily buy the military special tickets.

Now the question. DH is a Florida resident. So, we'll be buying seasonal passes for him & our kids. A couple of years ago, they passed a Military Spouse Residency Relief act, basically saying that military spouses don't have to change residency every time we move. Because of this, will it be possible for me to get a seasonal pass as well, with my military ID? I just want to be prepared for which tickets to buy :goodvibes .

I would certainly hope so, but I don't know the answer. I'm sure CF will be by soon with a concrete answer.

If you don't have a Florida License or State ID, check the bottom of this post

These are the official rules:

Florida Resident tickets are only available to actual Florida Residents and cannot be purchased for out-of-state family or friends.

An adult Florida Resident may purchase Florida Resident media for more than one Florida Resident from any location that provides an exchange certificate and not an actual ticket.

Children under the age of 18 are not required to provide proof of Florida residency if they are accompanied by an adult with valid proof of Florida residency

If the Guest has an exchange certificate, a valid form of Florida ID will be required when the exchange certificate is redeemed for the actual pass

One ticket only per valid proof of Florida residence (a Florida resident may buy tickets for minors in the party)

Exchange Certificates may say:

"After sale..., may not be transferred except as a gift." This means that the certificate may be given as a gift, so long as the recipient meets the defined Florida residency criteria.

"Purchase and redemption of this exchange certificate requires proof of Florida Residency."

The following items are the only documents accepted as proof of Florida Residency:
* Valid Florida State Drivers License
* Valid Florida State issued ID Card with Florida Address
* Valid Military ID stationed at one of the Florida Military Bases listed below:
(List of bases removed as unneeded)

As of August 20, 2010, Voter Registration Card is no longer an allowed ID
As of August 20, 2010, Florida University/College Student ID is no longer allowed


For Part-Year Residents the following original documents are acceptable.

Note that fax and photocopies are not acceptable, that bills and mail cannot be more than two months old, that PO Box addresses are not allowed, and items related to Time Shares are not permitted.
Must have a driver's license or state photo ID card from another state, or a non-US Passport and at least one of the following items which does show a Florida address:
* Monthly mortgage statement
* Current homeowner's insurance policy or bill, current automobile registration, insurance policy or bill or current utility bill (Power/Phone/Cable/Water).
* Statement from a financial institution showing checking, savings or investment information or mail from a Federal or Florida State, County or City government agency.

Effective August 20, 2010 Proof of Rent, Mortgage or Ownership such as a Deed, mortgage payment booklet or residential lease are no longer allowed.
 
That looks like a "yes" to me, if you have a florida militray ID, and Disney should allow you to get a pass...
 

We are FL residents, but are stationed in VA currently.

We still have our FL DL's, but with VA adresses on them.

All we did was show our FL DL, military ID, and we brought along a form (I forget which one) which states that DH's "home of record" is FL. I also had my FL voter reg card and our FL car insurance card.

The CM at the ticket window never even asked for anything but our DL and military ID's.
 
I will preface this by saying I don't know how Disney specifically will handle it. That said, the Military Spouse Residency Relief Act does not automatically grant the spouse the same residency as the MM. I dealt with this a lot when MSRRA first went through, as my husband was a PA resident, and I wanted to get my residency back to PA as well (we had moved twice before MSRRA passed, and I'd had to change my residency for both moves). I spoke with base legal, and I was unable to regain my PA residency.

Most states require that the MM and the spouse have the same state of residency in order for the protections of MSRRA to apply. The spouse is required to be able to prove residency apart from the MM (i.e. the MM's residency status doesn't equate to spousal residency). If you're unable to prove that you, the spouse, are a resident of the state yourself (via the normal methods of proof of address, living) - then MSRRA doesn't apply to you.

I would recommend visiting the MSRRA facebook page - there are many knowledgeable people there who have resources regarding each states' interpretation and enforcement of MSRRA. ETA: Here is another informative article about MSRRA

If I were in your shoes, I would not expect to be able to get a FL seasonal pass (unless, as Cheshire's post mentioned, you're currently stationed in FL). In your situation I might still attempt to purchase a FL seasonal pass, but I would plan on purchasing a different kind of ticket.
 
Thanks, Angel Ariel, for the clarification on MSRRA. It seems like it's one of those things they passed to try to help people, but it doesn't really apply to most of the people they were trying to help... :rolleyes:
 
My sister's husband was military and they based themselves in Florida for the same reasons so many other military families do. :)

They got the Florida resident discount.

I don't know the ins and outs of it...or if the rules have changed or not, but they got it. And they weren't actually living anywhere near Florida at the time.

I'm going to do like was suggested and attempt to buy the seasonal, but plan to buy the other tickets, and just buy 2 of them to use for myself, since we'll be there for 8 days :banana: . Leaving in just over a month!
