First time buyer question about fidelity

Hey all!
To all whom have used fidelity w first American title insurance company for their resale contract.
How long did it take for first American to pull the money from your account (I used a credit card w the authorization form) after the closing documents were signed by both parties?
Also; I was told that it wouldn’t be sent to Disney for ROFR until after the deposit was taken from my account and verified. Is this correct information? Thanks in advance!
 
It went to ROFR within like 1-2 days last time I bought through them about a year ago.

Not sure what it is like during the current time.

As far as CC Payment not sure how long it took didn't really track it.

I was I received an email on Tuesday. It was sent by Fidelity at 6:55PM EST

Hello, please find attached a copy of the executed Contract for your timeshare transaction. This copy is for you to keep for your records. Thank you for your patients on receiving the executed contract.

The Right of First Refusal Request for your file has been sent to Disney on: (redacted Date)

If Disney exercises Right of First Refusal, the deposit will be refunded to the Buyer and Disney will become the new Buyer for the transaction.
If Disney waives Right of First Refusal, we will send the file to the title company to continue on with the closing process.

Please be assured that we will advise you as soon as we receive the Right of First Refusal decision. Disney can take up to 30 days to deliver the notification, so please be patience during this process.

You can try just touching base with Fidelity as well. Don't hound them daily for an update on if ROFR had come back (use the tracking thread here to get an idea) but I would absolutely just touch base if your contract will go out today or tomorrow for ROFR.

Thank you! Yes I am going to call tomorrow for an update. I emailed her earlier but haven’t heard back, I don’t think she tends to use her email much but whenever I’ve called she always picks right up.

I have a contract going through them as well and have had to call to check status (only after waiting 1 week in between and when I do not receive any confirmation or follow-up). All contracts were signed on 18 Jan, but I had to call on 25 Jan for status when my credit wasn't charged and it had been a week. Bonnie looked into the issue and said something was needed from seller and a signature for a signature was needed from my husband (it had to do with our current use year and joint doc I guess if we split?). She said if all came back, my escrow would be charged and contract would go to ROFR right after (by 26 or 27 Jan). I never received any other emails, but noticed the credit card was charged so I assume it went. I am waiting on a call back or an email reply for status as of today, 1 Feb. Once it goes to ROFR, I have noticed it can take several days to several weeks.

The comms are not the best and this is definitely a different experience than with the last broker, but the price is great and I don't mind following up with emails until I at least know it was sent and they are not waiting on anything from me.

Thank you for this information. I just spoke to my agent and she said if my card isn’t charged tomorrow she’s going to call and figure out what is taking it so long to be charged (probably didn’t help that the contract closed Friday late afternoon). So hoping maybe it being Monday the title company was busy and that it’ll be charged tomorrow. If not I’m definitely going to follow up. Thanks again :)

1/20 I called to ensure they had everything and ask when it would be sent to ROFR, my kids want to make a paper chain. Broker told me to assume it's there but she would let me know by 1/22; also deposit had not been taken
1/22 email sent to broker asking if our contract was at ROFR (no response)
1/25 voicemail left (no response)
1/26 voicemail left (no response)
1/27 voicemail left (no response)
1/27 FINALLY got a hold of agent, told me she would get me an answer and let me know on 1/28
1/28 - NOTHING
1/29 voicemail left (no response) received an email at 4:58pm that did not answer the ROFR question nor did it address why our deposit had not been taken. Broker asked if she could call me on Saturday
1/29 I emailed the contract specialist to ask if it was at ROFR (no response)
1/30 - SHE NEVER CALLED
2/1 - called and she still did not know about ROFR. I noticed the deposit had JUST been pulled. Broker told me she would call by the end of the day today and let me know about the contract - SHE NEVER CALLED
2/1 - I called the Title Company. They did not RECEIVE the contract from Fidelity until 1/28 and it was sent then.

This evening I am crafting an email to Fidelity's management. I am also going to advocate to NOT pay their $195 admin fee. I'm just going to call the Title company moving forward!!!!

Wow I’m sorry that happened to you! That’s really annoying. I do think there is some communication issues between the agents/brokers and the person in charge of all the contracts and getting all that sent out and signed. I actually talked to my agent today, who is really good, and acted surprised that I hadn’t had the money taken out yet from the title company. She said to call her tomorrow if it doesn’t come out, I am going to call the title company myself tomorrow if it doesn’t come out knowing that she isn’t the one to directly send it out. I have a feeling it hasn’t been sent to them yet. But yes I am certainly going to make sure it gets sent to ROFR asap, she said it would be the next day after the deposit is verified. Legitimately as I sent that email the title company withdrew the money from my account lol. Just as an update, I am surprised to see it done so late figuring it would be done by 5 or not at all. Who knew!

FWIW, our experience with Fidelity was somewhat similar and it sounds like communication is not their strong suit. Had an issue with our resale contract after closing. After about a month of frustrating back and fourths with the broker and her boss, they agreed to refund the $195 admin fee as compensation for the error. It has now been almost a month since they agreed to send a check for the $195 and we still haven't received anything. I reached out to the broker last week for an update and still haven't heard back.

Like I said, their communication certainly leaves a lot to be desired.

I called the title company myself after my broker continued to not respond. The Title company gave me a clear answer, but they did NOT have my contract until a day or two before the deposit was pulled.
 
All of these experiences seem to be very dependent on the person or the situation. I am also in the process of buying my first contract, also through Fidelity. I made an offer on Sunday, it was accepted Monday, we got the contracts signed Monday night and the deposit was taken from my account yesterday. I also received confirmation that we had gone to ROFR yesterday as well.

It's very strange that people are having such varied experiences. Not sure if it's the broker him/herself, the sellers, or what would explain the differences. Either way, I hope everything gets straightened up quickly and everyone passes ROFR successfully!
 
Wanted to update everyone that I had a great conversation with Mary at Fidelity today. She is the VP of sales. She shared that due to Covid they lost a lot of staff and suddenly when January hit their sales have been through the roof. They are trying to hire, but we all know how that goes. She apologized for the lack of communication and promised improvement. They also waived by $195 admin fee. Shortly afterwards, my broker called to apologize as well! She promised to do better moving forward! Just wanted to post the positive from today! It's crazy for all of us right now, some more than others due to Covid etc. It was a good reminder for me to show grace and empathy :)
 
I’m glad you posted the positive resolution. This year has been so trying for all. While clearly they dropped the ball, grace is so important.

Sadly, this does not surprise me after inquiring about a property. They are very frustrating, but the prices are sooooo good!
