Greetings!

We live in Ohio. My husband has been working in Maine since May, but that job is ending in two weeks. Does he file for unemployment in Maine or Ohio?

Any ideas?

Thanks

It's the state where you reside. Check the Employment Security Commission for both states to verify.

My BIL lives in Delaware but files in New Jersey because the benefit is higher in Jersey.

Moving to the Community Board.

I think it depends on whether the states have reciprocal agreements. Neighboring states often do but that isn't your case. Most of the time, you file in the state that you worked and paid taxes unless there is a reciprocal tax agreement.

You are supposed to file where you reside but the benefts are based on where you worked.

Oh my! This is so confusing. If he could just find another job--NOW--I wouldn't have to stress over it. If he needs to file in Maine, I want him to do it before he leaves. If its Ohio, then he can do it when he gets home.

See, I would think it would be in Maine. The unemployment taxes paid by the company are in Maine's coffers, so that's where he'd file.

I'm not sure I see where it's confusing. Have you checked the Ohio unemployment website? http://unemployment.ohio.gov/unemployed_workers.html

If all his employment in the last eighteen months was in Maine, it appears he applies in Maine. If not all his employment in that period was in Maine, it appears he applies in Ohio. The site has information, and if it's still confusing, links to additional help/information.
