Estoppel Since Holidays

After reading this I'm just so glad we aren't stuck with ***. Our contract says on or before Feb 29. We filled out closing paperwork last Thursday, and they paid postage for the owners to overnight their documents back. Owners docs were there yesterday and title company took it to be recorded this morning. I was told it will be recorded by tomorrow if not today. Disney will have my contract first thing Monday morning.

I am not a patient person so I understand your frustration.


I guess I would point to *** if they had all the necessary information to close and for some reason there was a delay. Unless someone tells me otherwise, how can *** be held accountable of not getting the estoppel from Disney even though others that passed ROFR/submitted for estoppel after me and have already received their closing documents?

As this board has been so helpful to all my many questions, I can only assume if there was ANYTHING I could/should be doing to speed up the process, a veteran would have already told me. Like others, I would simply love to be able to plan a WDW vacation, but I am in the holding pattern. The process to this point has certainly tested my patience as there has been very little a person can do, but the overall process in my mind has been going on since September as I had a contract taken by the mouse in October.
 
Like many industries, I work in an industry where customer service is as important as the product manufactured. This certainly influences my expectations on when I am the customer. For many of you DVC contract veterans, what should my expectations be toward my title company? In reading the various invaluable threads (I know that negative comments will be more prevalent than positive ones), I understand that Disney works at its own pace (whether ROFR, estoppel, loading points, etc). I am paying the title company a fee which includes performing a service. Although this is my first time closing on a timeshare, it is not my first time closing on real property. I am used to "feeling the love" in my previous experiences. I am certainly persistent and maybe I need to take a step back, take a breath, and show more patience. At this point, I am asking every other day if they have heard from Disney on the estoppel (squeaky wheel method). In my mind, I am getting the feeling at this point, "Don't call us, we'll call you"; unfortunately that is not in my DNA. Understanding that there is little that can be done to speed up the ROFR process, am I living in a fantasy world thinking that the title company could/would contact the Accounting area at DVC to proactively determine the estoppel value and to get the supporting documentation? Until the closing, no money would transfer hands. Again excluding Disney, I would think if nothing else, money would motivate the final process to completion sooner than later.

Everyone who has bought resale in the last year certainly feels your pain as the time frame to close increased from late 2014 (some lucky buyers close quicker but the norm is more like 10-12 weeks. However I don't think it is realistic to expect that *** or any title company specializing in DVC Resales would hound Disney to supply estoppel information on a particular contract. They need to maintain a friendly working relationship with Disney (for the sake of all their clients) and can't afford to burn a bridge simply to make one customer happy (as much as we'd all like them to at times.)

Agree. You're given a closing date. It should close by that date. Be patient until that date. On our last contract, the deed was recorded with the OCC 8 days before our stated closing date. We received our member letter two weeks after our actual closing date. Being impossibly impatient before your actual closing date is futile.

We're waiting on a small add-on contract now. Passed ROFR 10 days ago. Closing date is 3/7. Not expecting much to happen between now and the first of March, quite honestly.

Thanks for all the comments. Maybe soon I can laugh at myself for being so impatient, however, it appears through these threads that people's patience are much different during the add on contract process than the initial one.

On that, I will agree, at least as it relates to me. However, it's also the voice of experience with the process speaking. As I said in my previous post, our original contract pretty much went the distance...with us receiving our points well after our stated contract closing date. Focus on your stated closing date, as it's really the only thing that matters to your particular circumstance. Maybe you'll get lucky and close before that date, but I wouldn't expect it.
