I just won an item and the lady ,after it closed, emailed me that her daughter took them back and she didn't have them anymore. :confused3 On my ebay it still says I need to pay for one item, so will she take it off and also should I leave a neg. feedback? I don't know what to do?!?

I think I would look at her other feedback first & see if she has a history of deals "gone bad". Then decide whether you want to make an issue of it or not. Maybe it was just an isolated mistake on her part. Maybe she's done it to others?
Either way, sorry you won't get your item.
But, hey, maybe the next one you find will be a better deal?! :cloud9:

Could be an honest mistake. I would not leave any feedback at all. She can cancel your bid if I'm not mistaken. You can also remove it yourself.

If it was a "really" good deal, then I would suspect that she changed her mind about selling the item for cheap. That happened to my DD one time and she watched and the seller added the item a few weeks later. DD contacted her and asked if she would honor the price now that it was found. Never replied so DD left neg.

I did get a good deal and that is what I'm thinking might have happened. So I will just watch it.

OP stated the auction closed. Neither the seller or buyer can not remove a bid once the auction is closed.

I HAVE HAD THIS HAPPEN
I WON AN AUCTION FOR 4 GAP SHIRTS FOR $10.00 AND THE SELLER SENT ME AN EMAIL SAYING ONE SHIRT HAD A HOLE AT THE BOTTOM THAT SHE DIDN'T SEE BEFORE SO SHE HAD ALREADY REFUNDED MY MONEY ,NEVER ASKED IF I STILL WANTED THE SHIRTS AND SURE ENOUGH A COUPLE WEEKS LATER THERE THE SHIRTS TURNED UP ON EBAY AGAIN WITH A HIGHER START PRICE :confused3 :confused3

Remember the FEEDBACK system olny works if used properly .If you feel it was a NEGITIVE transaction ( auction closed agreement should be met) then post NEG if you feel a neutral then do that .Heck do nothing but then when they do this again it will be because people are letting them do business this way.

You will need to remove the item from your "items waiting for payment". Just go into my ebay and click on the items waiting for payment and you will have an option to delete the item. The seller can't do this. As far as feedback goes, I don't believe you will be able to leave feedback unless the transaction is complete. Not positive on this, but if you find a way to leave feedback, I would go with the neutral and just state the fact of what happened to alert other possible buyers.

You can submit a nonperforming seller complaint with ebay. I can't find the link but I'm sure someone here will have it. :) They sure make it difficult to find something!

Thanks everybody! I emailed her around 3 and she hasn't gotten back to me. I just think she said this because I got the item at such a good deal. I mean why would you list something then say oh my daughter decided to take them back instead. Haha yeah right! I'm going to go look for the nonperforming thing...they do make everything really hard to find.

Oh yeah this is shady. Somebody asked a question today/12-26 and she answered yes I will take a personal check. Oh sure you took them back.... :confused3

I have thought about the situation and I think I will leave negative and file a complaint. If I file a complaint will ebay be able to do anything or am I just wasting my time?

So you are telling me she relisted the item? Oh yeah if this is true definately leave negative and file a complaint. Ebay from what I know is pretty good about looking into things and following through. Let us know what happens.

This is where things get sticky, if you are buying something, sellers always quote that this is a legal binding contract. So, just because her daughter took it back doesn't mean it's legal. She sold it to you, you are the winning bidder, if you want the item I would tell her that she needs to sell it to you or make some sort of deal. Believe me, if you bid on it and decided not to pay it's a legally binding contract and I believe it goes both ways. If the woman said that it was destroyed or it broke or some ligitmate reason then I would say the heck with the feedback, but she told you basically that she gave it away! So yes negative feedback and if you still want the item, I would contact Ebay.

I don't think the item was relisted. My understanding is that on the auction, a person asked a question on the day it was to end about taking a check. Those questions now appear at the bottom of the listings for all people to see.

She should have known that it was unavailable and by answering the question, it does seem shady.

That is what I meant (what etwinchester said) . Anymore sugestions on what to do because I'm not sure (I still haven't contacted ebay).

This is the email she sent me.....

Hi, I'm sorry to inform you my daughter actually returned these,
after saying she wanted to sell them on here. So I no longer have
them, I'm really sorry & I hope you find another pair. Happy
Holidays, xxxxx.

and this is the ebay add.....

these are new with tags, purchased @ xxxxxxxxx xxx xxxxx (i still have the receipt if you want it). they are the grey color in size large. COMPLETELY sold out. i have to pay for xmas and i wont be able to get to the mall anytime soon to return these, so ill let someone else have them for cheaper. =) they are 100% authentic and retail for $24.50, the retail and manufacturers tags are still on with no cuts or marks. if you have any ?'s please email me and happy holidays! :-)

and here is the question....

Q: Hi! I had trouble paying with Paypal and I was wondering if I could pay for an item with a postal money order. Please let me know. Thanks!
Dec-26-05
A: Yes, if you'd feel more comfortable doing that that would be fine. I would just have to wait for the payment to clear before shipping the item. Thanks

Another question....do you have to tell the seller you are going to report them?

You don't have to tell the seller you are going to report them, but you should try and work it out with them first by telling them that they can't just list something and not go through with it and that it's a legally binding contract with you. She gave them back to her daughter so she can still get them. I think this woman is trying to pull one over on you. However, you should do something asap and don't let too much time pass.

Please keep us updated!
