I missed Dr. Phil so sorry if this is a dumb question but were the police negligent (sp?) in some way?

I feel like they were. I think they took the easy way out. They took the word of a scared 14 year girl who wasn't thinking right.

Don't you think someone should pay for this man having to be in jail for 14 years when he didn't do anything wrong
 
People make mistakes (picking him out of a line up) That poor girl!!! Clearly it was Not this unfortunate gentleman and he gave up 14 years for this mistake made against him and then a conviction likely based on that eye witness testimony! .
There are countless cases of DNA exonerating people years later...

Jurys make "mistakes" as well. Emotions/ideals, despite it being "based on facts"

But, at the same time, trying to now say Police may be negligent IF they based their case on an eye witness will not hold weight...what will is if they Knowingly/negligently had other avenues NOT explored...to the obvious detriment of this man!

Its a very sad situation all around! Her Safety (in her mind) is shot and part of HIS life was also lost.
As far as DNA goes, Thank Goodness there are now tests to exonerate people IF those cases even have an opportunity to get reviewed.AND the DNA evidence still exisits...there is/are law firms that specializes in JUST this aspect...many requests for their/convicts cases to be reviewed as they say they are innocent....

I couldn't watch it after seeing the ads for it. IMO, Dr. Phil has reached a new low exploiting this horrible experience of both parties for all the world to see.:sad2:

I disagree without them meeting on the show neither side would have got closure which they both needed

I used to watch him when he was on Oprah, and even some of his first shows on his own. But he has become so gratuitous that I can't stand to watch him anymore. And really, why does a psychologist need to have shows about give aways copying Oprah's favorite things? He has just gotten away from anything credible, again TOTALLY my opinion.

I think Dr Phil handled it well.
Maybe it was too early but the lady just really did not seem to believe it was not him. IMO, she looked scared of him.
They BOTH need closure but the man in prison has certainly paid a higher price. I would have hoped she could have been as contrite as the woman on the phone they interviewed. But, like I said, maybe too early.

That's what I was thinking. If DNA testing was available 14 years ago and his attorney didn't ask for it, then that is the real crime.
 
It's cases like this that come to mind when I hear people talk about how "all" prisoners are "guilty as charged" - or they wouldn't be in jail..

While certainly in the minority, I truly believe that there are a decent number of innocent people in jail who have been convicted of crimes they did NOT commit - and if they aren't lucky enough to have DNA prove their innocence, they will spend many, many years in jail for nothing.. Wasted lives and wasted tax payers money..:sad2:

I didn't see this show (so I can't comment on the woman), but I feel terrible for this innocent man and his family..:(
 
Actually there is something called chimera, it's where a person can have two sets of DNA. If you check out this article you can read more about it. But scientists are now saying that it's possible for someone to commit a crime and not be charged because the DNA from a blood test doesn't match the DNA on the evidence simply because they have two sets of DNA. Now I don't know much about this case but I would like to see them get more than a blood sample to test his DNA, take samples from his thyroid, liver and other areas to determine that he is not a Chimera.

Seriously? There is less than 50 of them in the entire world! Rare doesn't even begin to describe that disorder.

I think I will trust his DNA tests and trust his innocence.

I feel pain for the girl, she went through something unimaginably horrible. As much as she thought this was the man, he appears not to be. I can't begin to imagine how difficult that must be for her.

I honestly don't know the details of this particular case. If the police knew they were arresting the wrong person then they should be held accountable. But the police did not convict, or sentence him. The judge and jury did that.

I agree with pp about Dr. Phil. I loved him when he was on Oprah but not so much now.

This guy and his attorney requested the DNA tests, so they must have known DNA existed from the case; why would he have wanted a DNA test - knowing that a sample from the rapist existed and would blow any shot of an appeal he might have if he matched - unless he was certain it wouldn't match? He would have had to KNOW he was a chimera in order to be sure he could beat the system via DNA testing, and I don't see how that is possible if he had never had his DNA tested before (which he obviously hadn't or it would have been brought up in court).

I say this poor guy has been punished enough for something he didn't do and should be spared any further intrusions into his life regarding this case.

Actually I watched a documentary in which the scientists are suggesting that it's not as rare as we think it is and it's too difficult to say how many of us actually are chimera's without knowing it. I wasn't attacking you so no need to be so defensive, I was merely making a comment about how DNA testing isn't 100% accurate.

Entirely possible, like I previously mentioned I don't know much about this case and am not stating an opinion on whether or not I think there is a mistake. Of course it's awful that if he's innocent to have been punished for 15 years for something he didn't even do. I'm just not an advocate for DNA testing like I once was and if the girl was so sure that he was the one, I was simply pointing out how it could be possible.

i think this was her main source of anguish on the show. she kept saying that she was terrified of him. but then she really broke down when she tried to apologize to him. she seems to be more haunted by the fact that she was responsible for him being locked up for so many years based on her eyewitness account. she now has 2 separate issues to deal with. the brutal rape, and the guilt of sending the wrong man to prison.
i feel sad for both of them.
