A question reagrding ROFR.
Our resale contract has now gone to Disney for ROFR. It is a 50 pt OKW contract with all of the '05 pts banked and the full allotment of the '06 pts.
We bid at $87/pt.
I'm not too worried about the dollar amount not passing, as I've seen small OKW contracts recently pass @ $85 & $86, but will the fact that I am getting the banked pts (essentially decreasing my dollar/pt cost) from '05 hurt me?

Hard to say, but it has appeared to sometimes in the past.

It seems one can never be sure which contracts will be ROFR'D by Disney. My small resale OKW 26 point contract passed ROFR in less than a week in September. It had all 2005 points banked, all 2006, and all 2007 points available. I paid a little less than your offer. I hope this makes you feel hopeful! Good luck! :)

I would guess the size of Disney inventory at any one time would play a part in whether they will ROFR and also the price you are paying for the contract. If it is within a reasonable range Disney may let your contract through.

Anything related to ROFR decisions is a guess at best, but I don't think Disney looks at banked points. Banked points make a contract more valuable to the buyer because we can use them, but if you look at the number of banked points compared to the number of points left for the entire remainder of a contract, it's really a drop in the bucket.

Since Disney started ROFRing small contracts aggressively a few months ago, I've thought they were just trying to get the small contracts out of their system to reduce administrative expenses. But that's only a guess.
