Legally I think you have something of a problem as the security personnel offered medical treatment for your husband and he refused it. And yes, he did decline medical treatment (the sort that results in records being made). I am assuming you also did not file any report on site. I understand all you wanted to do at that time was to get your kids out of there, but it doesn't bode well for further contact with the company regarding the incident.

I think it's the case that you will not be getting an apology. They won't even talk to you about this. If you want them to talk to you, or to compensate you for medical costs you incurred after you left Walt Disney World, you will need a lawyer. That's how it is in this society.

we filed a report at the scene and again at the hotel and then called the phone number they gave us and tried to file a report there - which we were told to do but the person on the line was extremely rude and not helpful at all....
I don't know what other reports we should have filed but I do know that we told security at the time that he would go to the doctor after and that should have been documented in the report - however - as I said we were never given a copy of the report at the scene or at the hotel -
 
Good News!!! I got a phone call and an apology for EVERYthing and they are going to speak with transportation and review the tram policies and specifically talk to the two employees who were operating the tram at epcot that night AND they are going to speak with the person who took our call and was so rude to us....

I told them my fear of what could have happened and the person I spoke with said that they would take this situation very seriously ...

I feel better that they are taking it seriously and that they are going to review operating procedures....and if nothing changes - at least I made them aware and did what I could do

I hope this means that the trams will get some new policies but
 
I don't get it; why wouldn't you sue them? You'd certainly be well within your legal rights and it seems very justified. Yes, accidents happen, but this does sound like one caused by Disney.

Sue for what? $150?? To seek vengeance, strike back because you can? Financial gain? What exactly? We live in a sue happy country now and its sad. Not the right way to resolve anything and for the most part it wont resolve anything. The best thing to do is perhaps contact as high of authority at Disney as possible and explain the situation in hopes they will train their people to handle things better for future guests. Suing for $150 is pointless.
 

I've never ridden the trams at Disney World but have at Disneyland many times. On Disneyland trams there is the driver and helper up front. In the rear is another person watching the length of the tram. The tram does not move until both people front and rear give the all clear to proceed. In recent years trams have doors on them. The helpers will not give the all clear until they have made sure all doors are closed.

Obviously the CMs had a major problem that day, since all procedures were totally ignored. And DH and son could have been horribly injured from a fall etc. thy have to take this seriously and I'm so glad they got back to you.

Thanks! The what ifs are my current nightmare - yes we escaped pretty much unharmed (aside from the knee and some scared kids) - but what if!!!!! and not just what if for my family - but for the millions of other families that use the trams at WDW...something went wrong that day and it could have been VERY serious...thankfully it wasn't....but I do not want whatever happened that day to EVER happen again!!!

So I feel better that I got the phone call - that means that someone at least read my email and listened to my concerns - I also have a direct line to the person who called me so I can always call back to see what has been done if I don't hear anything more....

EXACTLY!!! I want to make sure that this doesn't EVER happen to anyone else because there are soooo many VERY scary other ways that this could have turned out....

Now, getting that information may be easy or difficult depending on the company. If it is difficult, then you will want to hire an attorney to pursue the matter. Additionally, you want to contact your health insurance company and let them know what is going on. There are departments within health insurance companies (Subrogation/Other Party Liability) who can help in researching where to send claims for payment. Just as in a car accident, use your cell phone or digital camera to take pictures. Pictures on the scene are a great source of evidence. Write down all details - who the driver was, location, etc. etc. The thing is if Disney had apologized and immediately helped to resolve the situation, your desire to legally pursue the matter may be less intense. If, however, there is inaction on their part, it makes a person frustrated and angry and a legal pursuit seems inevitable. There are those people who try to get as much out of a situation whether it is warranted or not, and you know Disney deals with their fair share. Regardless, they are responsible to resolve these matters appropriately and timely considering how much revenue they do bring in. I hope your husband's medical claims get paid.

THanks! We aren't pursuing any reimbursement of the medical claims because there were minimal co-pays and my insurance picked up the rest - if I hadn't gotten the apology - things might have been different just as you said - but that really isn't the type of person I am or want to be - so I am very glad to accept the apology and walk away :) hoping that they do what they said and retrain the tram workers and rethink their policy
