Contract Swapping

I was just reading through another thread about if people were happy with the DVC resort they had purchased into...and some of the responses got me thinking.... If two members had agreed to swap for each others resort, could that be done with just a title change, or would Disney have to exercise ROFR?? I know it may not be something that would happen every day, but if the points worked out closely, I think, why not and save the buyer and sellers fees with a minimum out of pocket...hmmm.....
Just an example...I have a 150pt contract at SSR, but could not buy at BCV or BW because there were no points available..and someone with 150 points at BCV or BW wanted to have SSR for a longer 50 year contract, can this be done?
what does everyone think???

I believe it has to pass through ROFR. My understanding is that any change of ownership on a contract, short of passing it along to an immediate relative, requires an actual sale. (I'm sure someone will correct me on the finer points of this comment. :D)

But, there's no reason you couldn't "price" the contracts high enough to pass through ROFR without incident. In other words, if two people agreed to buy each-other's contracts at $100 per point, there is no way DVC would exercise ROFR.

You'd still have closing costs to cover, and beware of any broker fees if you get an agent involved.
 
It would essentially be each selling to the other will two full closings, ROFR and two $100 transfer fees. Cost total between $400 and $1000.
