Confusion about height restriction at Soarin'...

It says 40" but if the child is too little there is a strap that goes between their legs to hold them in so my question is can my 38" tall DD go on this ride? Or is it only for 40" or taller no exceptions?

The height requirement is 40in. Anyone under that will not be allowed into the queue. The safety strap is for those kids who are just barely tall enough.
 
The official language is: "Persons who do not meet the minimum height requirement of 40" (102 cm) may not ride."

its not the 40" they are referring to. There is a mark on the seat back. If you are shorter than this mark you must use the strap in the middle additionally.
 

They check the height before you enter the line. If smaller than 40 inches you won't be able to ride.

I think it's for those who are short in the stomach up area, so they can't submarine out of the seats.
 
The height requirement is 40 inches. Once seated, if the person's head is not above a line (a yellow line, I believe) then they are required to use the between-the-legs strap. Our daughter is 49" in shoes, and she needed the strap. I'd guess that anyone under roughly 52 inches will be required to use the extra strap.
