states says the duct tape over the mouth and nose is what killed caylee

why the need for chloriform?
So that Casey didn't have to have a physical battle with her to get the tape on? :confused3
 
can someone tell me again why casey is in jail now?

if she was out on bond what happened that she got sent back in?i don tknow if i read it and forgot or just never found out
 
Perry was talking about shifting of the burden of proof:

shifting the burden of proof n. in a lawsuit the plaintiff (the party filing suit) has the burden of proof to produce enough evidence to prove his/her/its basic (prima facie) case. If that burden is met, then the burden of proof shifts to the other party, putting the defendant in the position of having the burden to prove he/she has a defense. There may be shifts of burden of proof on specific factual issues during a trial, which may impact the opposing parties and their need to produce evidence.

So it seems their comes a point where a defense does have to prove something If I am understanding this correctly. (probably why there is such a thing as an alibi...defense just can't say their client didn't do it and call that a defense. They must SHOW it. I guess they aren't.)

JB second search warrant in December 11...any receipts,containers,rags, chemistry kits--No

JB were you looking for that--Would have to see search warrant

JB next is December 20 hands him 12/11 sw again YM tells hime where to find 12/20 sw

JB why--we looked for it already on the 11th

LDB was defendant home on bail--yes



JB you can get a sw anytime you want--yes if evidence warrants

JB you didnt think evidence was significant enough--not that it wasnt significant--we were looking for a live child

JB when Casey arrested on 7/16...Oct 14 she was arrested again on more serious charges...you never went in to search till 12/11---thats correct

JA what youre saying is that the proximity of the tape to rotting flesh has no bearing on the outcome---yes it does

(I know JA made a point with the above but I lost it :headache: )

If the tape was on the body and it was decomposing, that would increase the chance that the tape DNA would also be decomposing. If it was away from the body, the chance of degradation would be smaller. However, the environmental conditions would be a factor. It does make a difference if it is in contact with decomposing flesh.

Believe she was arrested on the check charges. And while she was in for that, I think they got enough to keep her there for Caylee's death.

But she was rearrested on charges unrelated to Caylee to the sound of a cheering crowd of protesters.

Leonard Padilla bailed her out of jail because he thought she would lead them to Caylee, when she would do nothing to help find her he revolked the bail and she had to return to jail

Would she be out if she wasn't serving time for her other felonies? I would imagine she'd have pretty high, unreachable bail, if any, for this murder charge. Who would trust her not to take off?

There was a case in RI where a guy was found guilty of murder, and NOT HELD...I guess he was supposed to just go back for sentencing. He and his wife disappeared that night or the next day. Their car was found on a bridge. There was speculation that they had staged a suicide and taken off. A long time later (?) one of her leg bones was found. Nothing of him has ever been found. That's one of those mysteries that makes me crazy. I wouldn't be surprised if he shows up alive someday. But...why they let him out after a conviction, I don't know. He had nothing to lose by taking off.

Actually, I don't understand Burden of Proof. LOL I just know how to cut and paste. It was my understanding that the defense doesn't have to prove anything, or offer a defense or a case. So are you interpreting it to mean that since they made certain statements of proof/evidence (not quite sure how to word that), they need offer proof of it? Or am I way off? Or am I not making sense at all? lol
