What was his theory?

Also--does anyone believe him when he says someone took him to the Anthony's and that it wasn't his idea. For some odd reason, I don't think he was as gentleman as he sounds. (that he told the lady it was a bad idea, etc)

Kidshop did a pretty good job of summarizing Padilla's theory above. Basically, he believes that Casey used chloroform to sedate Caylee and accidentally killed her by giving her too much, which sounds plausible when you consider the chloroform searches on the computer. According to the theory, Casey then attempted to bury Caylee in the backyard but couldn't because the ground was too hard, which sounds plausible when you consider the fact that she borrowed the shovel from the neighbor and the cadaver dogs hitting on the same spot in the backyard. I still think Padilla is a crackpot, but even a broken watch is right twice a day, right?
 
The jury hasn't seen any evidence that she was in conflict with her mom, though, right?

No, I don't think so and don't think they will. In the beginning, in cover up mode; no one disclosed it, so they can't bring it up now. Cindy already testified it was all hugs and kisses goodnight on the 15th.

And they can't talk about the stolen money, which was what the fight was allegedly about.
 
It wasn't an accident. Even if it was, the state could prove child abuse and still get a death sentence for Casey.

I believe Casey repeatedly drugged Caylee. The computer searches included ways to kill someone, not just drug them. She was planning to kill Caylee. I have no doubts on this.

I think she may have switched to chloroform because it was a cheaper substance. She drugged Caylee, then suffocated her with the duct tape. She put the sticker on her mouth, just in case her attempt failed. She could then tell the little girl it was all a "fun game". Maybe she had taped her in the past, just in case she awoke before her mother returned.

Caylee was dead in the trunk when Casey went to the video store. Casey carried through with her plan after fighting with Cindy the night before.

Why do I keep hoping that they put Casey on the stand and a "Legally Blonde" move is pulled. You all know the scene ... where Elle is questioning Chutney on why she would wash her hair immediately after getting a perm "because isn't the first cardinal rule of perm maintenance that you're forbidden to wet your hair for at least 24 hours after getting a perm at the risk of deactivating the immonium thygocolate?" and Chutney blurts out that she didn't mean to shoot her father!

I know, I know ..... wishful thinking and real life isn't like the movies, but I would love it if Ashton got her so discombobulated that she blurted out that she did it!
 
It may fit the textbook definition of premeditation (not sure, I am not up on the law) but I am saying I don't believe the states version of premeditation. I don't *think* the chloroform searches were meant for Caylee and I don't think the website searches were related. Who needs to research how to break a child's neck? She is a tiny little toddler. The only use I find in the website searches is that she was plotting a way to kill her parents or to frame her parents. I also don't think watching a murderous movie with her boyfriend spurred her on. I think she got into it with her mom, did the deed without thinking, panicked, tried to reach her parents multiple times and when they didn't answer she went into Narcissistic Casey mode.



This is what I think at this point, too.

If Casey does take the stand, the verbal exchange between her and Ashton or LDB (who I think would be the most likely one to question her) will be on par with the exchange between Jack Nicholson and Tom Cruise at the end of the movie A Few Good Men.

One of the tactics allowed during cross examination is impeaching a witness. If Casey comes onto the stand to try and sell the jury on the accidental drowning story, then the prosecutors are allowed to bring up her lying, stealing, etc during cross. Casey's stealing from her family may not come in, but her recent convictions for theft will. That's why putting her on the stand is a suicide mission for the defense.
 
I am just not sure I can buy premeditation in this case. I needed the state to prove to me that Caylee was a burden to Casey and I don't feel they did. Friends and family claim she loved that little girl and since I didn't know her personally, I have to go with their assessment. Casey had built in babysitters, so again, I am not seeing the burden issue. .

See, maybe I have a different view because much of my information is from witness interviews. I'm just the type that wants to hear things from the horse's mouth. ;) Let me give you an example from Ryan Pasley's phone interview with YM on 7-30-08 (Ryan knew ICA since they were 5-6 yrs old; Ryan was listed in ICA's cell phone as one of her "best friends"):

We keep speculating on why we haven't heard from any of ICA's old friends - IMHO, it appears many, if not all, eventually were burned by ICA's lies or "mooching" (as RP put it) over the years. Lauren Gibbs babysat for Caylee in her early months. It wasn't until she found out ICA was out having fun instead of "working" that she quit being taken advantage of. Here's an example of how people blew off her lies:

RP: She was supposed to give it back but I, I, I lent her four hundred dollars for what she said was rent to her parents, which it didn’t make any sense really to me because I would think that as a single mother that doesn’t really have the faculties to take care of a child they’re not going to charge their daughter rent.

RP: But I went along with it anyways because whatever. I don’t know. I guess she needed it more than I did.

RP: So I gave her the four hundred dollars and I guess during that time she was telling her mom she worked at the Sports Authority and many like nights that she’s out uhm, that her excuse was that the reason why she was staying out late is because there would be inventory, things like this. And that the only reason why her mom never really got upset about it, and this is what even Cindy told, the only reason why Cindy got upset about it because she knew I was there and that she was okay, when in fact this never even happened.
YM: Hmm.
RP: She never, she never, she never worked there. She just hung out with me. Because I was (inaudible).
YM: Let me guess. Was this the Sports Authority over here at Waterford?
RP: Uh, it, uh, well no. Originally that, uh, this is what uh, Casey, uh, Cindy told me is that originally she worked at the one with uh, me, uh, with me uh, at 436 and Colonial.

RP: And then she transferred to the one uhm, in Waterford.
YM: But she never worked for Sports Authority.
RP: Never worked at Sports Authority. But that’s what’s she, that’s what she told her mom.

RP: No, I found, I found this out uhm, about a month, no, not, uh, three months, maybe three, three and a half weeks before Caylee went missing. Her mom, Cindy…

RP: …called me and told me not to talk to Casey because she didn’t want me to get hurt because she’s been lying about a lot of stuff, and put her in, stole money from her and her grandmother. And she doesn’t want me to get hurt, you know. Which I, you know, I was, I said, “Okay. You know, I understand.” And she, you know, she seemed really upset. She was just calling me to tell me all, what was going on and, and also to ask about some lies that she had suspected Casey of telling.
YM: Oh.
RP: Uhm, so she actually phys…she just called me. Her mom called me uhm, you know, uh, in my summer semester, at one of my classes. I remember the specific time and what I was doing. And she basically told me, “I don’t, I don’t think it’s a good idea that you even talk to Casey anymore because she’s a,” uh, the actually, those are the exact words that came out of her mouth was that she was a sociopath.
YM: And that’s, and mom said this?
RP: Yeah (affirmative).
YM: Wow. And does that match the Casey that you know?
RP: Uhm, it makes sense. I just thought that Casey was just a little bit of a white liar, you know.

While all this lying doesn't necessarily translate into ICA being a killer, I do think it's significant ICA had more of support system in place in the earlier days of Caylee's life. Lauren Gibbs babysat; when she was engaged to Jesse, he & his parents babysat, along with CA & GA. I think her friends Kristina & Kiomarie also babysat, thus giving ICA quite a bit of free time in the early days. Eventually, all those sitters drifted away and more & more responsibility fell onto ICA, CA & GA. I imagine GA was able sit more during the day at the times he wasn't working.

Fast forward to when Caylee hit the "terrible twos", GA is working more, CA continues to work full-time and maybe getting a little tired of spending most of her evenings & weekends caring for Caylee, while ICA was starting to hang out with her new "single" friends. (Lauren, Kristina & Kiomarie were also young mothers).

When dating RM, he was ok with Caylee spending the night at his apartment, but TL didn't go for it. I don't take a lot of stock in these singles claiming ICA was a great, loving mother. I'd bet they only saw Caylee on occasion, when ICA "trotted" her out to appear to be a great loving mother.

Sorry to rag on about this, but I find these interviews give a glimpse into ICA's interactions and motivations. Yeah, some parts are boring (all the umm, uhhh, ohhh's) ;) but well worth it.

The lying, yes, as they've already admitted to that. However, unless the defense brings in the theft convictions, I don't think the prosecution is allowed to bring it up. However, even w/o the thefts, the prospect of putting her on the stand is risky, to say the least.

I believe that if the defense brings her on the stand for the purpose of explaining her latest defense, then any prior felony convictions can come out because she is the defendant. If it were another witness, then no, prior convictions cannot come out unless the defense brings it up, but those felony convictions that Casey has will be brought up of the jury to hear if they are dumb enough to put her up there.

That is what the good Dr. claimed, after he claimed the tape wasn't on her at all. The defense makes no sense.

There was no tape on the skull, but it was applied after decomp??????? You can't have it both ways and to me thats what he testified to.

*Mare leaps to her feet and applauds!* ;) All of the above! I think if I had to pick a "twin" as far as viewing this case, it's you. :flower3::lmao:

As I may have mentioned a few million times on these threads, I'm going to be a first time grandma in the Fall, and I'm over the moon in love with this baby already. And, my DD is married (now :blush: ). When DD goes back to school the following Fall, I plan to drive the 2 1/2 hours however often to babysit. And will love every minute of it. But, if she were living with me, and I found out she was lying (as it appears from the interviews above Cindy did know) and I was doing too much of the childcare, you can bet I would not be happy! It's NOT like Casey had built in babysitters in her parents; I'm sure her parents, like most parents in these situations, expect their daughter to take care of her own kid! Doesn't mean they aren't overjoyed with their grandchild (we know they were), but getting dumped on is a whole different thing. Cindy and George were probably, at that point, laying down the law. I have a BFF who has a daughter and grandson living with her, and she loves them both, wholeheartedly, but it's frustrating for her to have raised her kids, and now when they're all adults, she's tied down to a grandchild according to the daughter's schedule. If she found out her daughter wasn't working and stealing? I'm guessing she'd be saying "that's it!" about providing childcare on a whim.

DD and I were discussing her will and guardianship, and thankfully, I have another DD who would be willing to step in and take her niece/nephew, if God forbid, anything ever happened. And if I had to, I would take my grandchild and raise him or her and love that child with all my heart. But honestly? I'm done raising kids, and I seriously hope I don't have to do it again. I will be there as much as possible to help out, and treasure time with my grandchildren, but first and foremost, my kids will be their parents, and I expect them to raise their children.

I can most certainly imagine a 20 year old questioning how her life would have been different if she hadn't had a child so young. Questioning her life doesn't equal wanting to kill her child. I've questioned how my own life would have been different if I had children earlier rather than later and my kids are still around! And to me, with all the "uh......you know..uh" I really don't think he had anything earth shattering in there. After thousands of pages of interviews, one person has two lines saying that she questioned life without her child. I just don't see that as a smoking gun that she didn't want Caylee. Plus, she had a very easy out. She could have walked out that front door without saying a word and left Caylee behind for her parents. I doubt they would have minded one bit and I doubt they would have spent a whole lot of time searching for their daughter.

Okay, I get what you say about the '2 lines' and all that, makes perfect sense. I just don't get what point you're trying to make w/the rest of the comment?
