I completely understand that Baez's job here is to poke holes wherever he can - timelines, witness testimony, evidence, ect.

BUT, he is not coming across, to me at least, as verly likeable. I think that harms the defense's side.

Yes it is the job to make holes, but he does not have the experience as far as questioning goes. All witnesses go over there testimony. And he can not refer to his opening statement

He was very matter of fact and said no. And he was very hurt by it.

My perception. Sleazy Baez carefully started planning this defense way back, by having Casey write letters to fellow prisoners, to get it out there in writing. He couldn't just start throwing it out today.

Commentators are saying how much Baez needs to back up his statements...he's basically putting out criminal accusations against several people.

Also said that George gave very strong answers.

Proof - It is true that the defense need not prove anything to any extent, even if they blame dad 100% in their opening statement. The only time the defense has to prove anything is if they are asserting an affirmative defense, such as justification. In NY, if the defense asserts justification they have to show something to that effect - but it can be done without putting on their own witnesses.

Cross-examination: It usually takes awhile. Frequent objections and sidebars are not abnormall. Some attorneys reask questions to see if the answer changes or to shape their narrative. Think of a good cross as like Mary Had a Little Lamb:

Attorney: Mary had a little lamb.
Witness: Yes
Attorney: And her fleece was white as snow, right?
Witness: Yes
Attorney: Everywhere that Mary went, that lamb was sure to go.
Witness: Correct

You as the attorney doing cross want to illicit the details and the version that backs up your argument. Defense attorneys mainly cross and prosecutors mainly do direct. So they sometimes are not good with the other. Many defense attorneys ask leading questions on direct (which is not allowed) and many prosecutors are uncomfortable with cross.

If (when) Casey is convicted, I think the death penalty is too light and too fast. She should be imprisoned for life in an 8x8 cell with big-screen TVs on each wall with a continuous loop of Caylee's life, so Casey can be continuously reminded of what she did. But she's so psychopathic, it probably wouldn't faze her.

I have a question. How will the defense try and substantiate the molestation charges without putting Casey on the stand? Do they have to ? Can a defense attorney just shoot things out there without proof? I figure if Casey doesn't testify to it then its all hearsay, right?

And why not save all those reasons for Casey behavior for the penalty phase?

They only have her letters, they dont want her up there. I think the jury will see that Casey has lied so much, that just because she wrote it doesnt make it true. They can claim that all they want it does not make a murder for her. Baez in my HO has thrown himself under the bus. It will be hard to prove molestation with out her saying anything, but dont bank on her testifying.

The state is the only one that has to prove anything. All Baez did is try reason away why she is not guilty.

I'm not rigs but...the prosecution's case is based so much on Casey's lies, I think the defense had to put it out there right away WHY Casey lies.

Yes, but they just can't shoot out accusations. I know there is something called an affirmative defense, just not sure how it works. I figure if you shoot something out there you would need to show the jury why this is true. How will Baez support his molestation accusations when its time to present his case? Otherwise, all defense lawyers need to do is go up there ,saying anything and let it be.
