Commentators questioning big time allegations about George finding Caylee in the pool and not calling 9.1.1. immediately. Just doesn't make sense.

Roy Kronk...commentators saying Ray Kronk's story was always odd...calling 9.1.1. twice in August and in the end, being the one who finds the body in December. That whole thing IS weird. Per Jane Valez, it seems to be the part of the Defense's opening statement that made the most sense.

Like Jane Valez said "Here's where I have a problem with the overall defense is that you start out with this wild story, then you go to this wild story with Roy Kronk...how many demented people can you put in one storyline?"

Casey (as far as I know), never saw a psychologist/psychiatrist during her incarceration until recently and only then for 4 hours. That simply is not enough for Jose to say what he said to a nationwide (international?) audience.

What prevents any DA from making stuff up in the future?

We now all have an image burned into our retinas that may or may not be true and Baez can simply say such filth because his lying client claimed it?

He made a criminal accusation!

I am beginning to question Baez's credibility in this way: I am beginning to think he may be corrupt. Casey loses---she is throwing him under the bus.


Proof - It is true that the defense need not prove anything to any extent, even if they blame dad 100% in their opening statement. The only time the defense has to prove anything is if they are asserting an affirmative defense, such as justification. In NY, if the defense asserts justification they have to show something to that effect - but it can be done without putting on their own witnesses.

Cross-examination: It usually takes awhile. Frequent objections and sidebars are not abnormall. Some attorneys reask questions to see if the answer changes or to shape their narrative. Think of a good cross as like Mary Had a Little Lamb:

Attorney: Mary had a little lamb.
Witness: Yes
Attorney: And her fleece was white as snow, right?
Witness: Yes
Attorney: Everywhere that Mary went, that lamb was sure to go.
Witness: Correct

You as the attorney doing cross want to illicit the details and the version that backs up your argument. Defense attorneys mainly cross and prosecutors mainly do direct. So they sometimes are not good with the other. Many defense attorneys ask leading questions on direct (which is not allowed) and many prosecutors are uncomfortable with cross.
 
Yes, but they just can't shoot out accusations. I know there is something called an affirmative defense, just not sure how it works. I figure if you shoot something out there you would need to show the jury why this is true. How will Baez support his molestation accusations when its time to present his case? Otherwise, all defense lawyers need to do is go up there ,saying anything and let it be.

The defense can say what they like, they still dont have to prove anything, the burden of proof only has to be shown by the state. Casey does not have to testify about anything. She may if she chooses to so. But the defense needed to lay out something so they were going with anything they could get a hold of. I know it seems wrong but that is just the way the law works.
 
Baez is freaking condescending.

Maybe GA can just say she looked fat or pudgy--but wasn't screaming pregnancy!

Wonder if Baez has ever seen "I didn't know I was pregnant".

Baez is wondering if GA ever noticed Casey retaining water before.

Beth Carras is saying that Casey WILL testify...that obviously Baez, in his opening statement, has made representations and promises that can ONLY come in through Casey Anthony, so "we're going to hear her."

George has been very honest I believe. His granddaughter just sticks out in his mind more as being the last time he saw her. I cant remember what shirt my DH wears everyday. I can say jeans and his boots, but shirts. Geezz

George suggested that he thought maybe she was just retaining water when questioned about the picture of Casey at the wedding, obviously looking pregnant, and George and Cindy didn't know yet.

That is a BAD plan on Baez's part if that is what is to happen.

She can only plead the 5th on what she is accused of---I don't think she can plead the 5th on cross examination for what she accuses others of doing or having done. She will be toast.

I think Nancy is talking about George being questioned about Casey looking like she was retaining water. That's George saying he thought she looked that way. And I'm with Nancy...my DH wouldn't notice whether or not I was retaining water; it does seem odd that George would think that (and to the 6 or 7 month pregnant state) about Casey.

Did you guys notice that George and Cindy changed seats? Weren't they on the defense side at the beginning? And then when he was done they were on the prosecutors side? Or am I imagining things?
 
OK he has to be trying to show what an incompetent attorney he is so she can get a new trial. That is the only explanation! LOL

Oh this is getting ridiculous. Baez is a moron. George is doing a great job, has a lot more patience then I would in the same situation.

I completely understand that Baez's job here is to poke holes wherever he can - timelines, witness testimony, evidence, ect.

BUT, he is not coming across, to me at least, as verly likeable. I think that harms the defense's side.

That is not a good thing. The trial I was on the jury for we all that the attorney was a jerk and while they settled before we could finish the trial I always wonder if that would have clouded our judgement? And no we did not discuss the attorney before we were dismissed..we chatted afterwards because they had us wait because the attorneys wanted to come in and talk to us.

I could not watch it uninterrupted, but the only reasonable doubt it gave me was in his ability to be a trial attorney. I am firmly and reasonably doubting his abilities. So in that regard, he did "well" at creating reasonable doubt. ;)

I'm just reading comments here so I might not be reading everything right and I don't get to see everything so it is harder to keep track of comments and who said what when.

BUT I am glad that you guys are keeping a running summary during the day. Work for some reason thinks I need to be paying attention to my job and not watching stuff online. :confused3 ;)
 
I just started watching the court proceedings on TV today. I only caught what the defense opening statements. He is saying Caylee drowned in the pool. Why then did Casey or George use duct tape on her mouth if she died by drowning. No need to quit the child as she is already dead. Does not make any sense to me. Susan

I didn't see the pregnancy pictures but I can say that with my first pregnancy we didn't announce it until I was over 6 months pregnant. Some people were surprised and some people said they had wondered.

He has a ways to go of how to get the experience. I mean we all need experience to learn and that is why he was told he needed another person that was experienced in murder trials and the fact he had not had enough time doing this. You think Mason would be guiding him more than he does. I agree very reasonable doubt about his opening statement.

Casey does look pregnant in those pictures, I have to say. My niece has 6 children, and announced her pregnancy with her 6th when it became obvious. at about 6 months and she could no longer hide it. (She doesn't live near me, so I didn't see her, but that's what her twin sister told me.) And she was (is!) skinny! I, however, went to my parents' 50th anniversary party when I was 9 WEEKS pregnant, and my cousin cornered me and asked if I was pregnant. :rolleyes: But again, those PICTURES of Casey? I can't see how the parents didn't know, UNLESS she was hiding it well in sweats or something, and being in that dress for the wedding it looked more obvious. And I can certainly see parents being in denial. They do seem to have a denial thing going on.

Jose Baez collected two hundred thounsand dollars from a book or something like that from ABC. He then had to ask the state to pay now as Casey is indigent. Jose was questioned about the money he did not want to answer and he eventually admitted to getting that much and where it came from. So the state is now fitting the bill. And he worried about Kronk collecting a reward.:sad2:
