Cancelled contracts - how does it work?

Since I can't get my guide to call me back :sad2:, maybe someone here can answer me.

I was in the process of adding on 2 small BLT contracts when the new 2010 point charts came out. Since the amount I was adding on each contract would no longer work as I would now not have enough points for my planned vacations, I cancelled my contracts. (I actually called my guide as soon as the point charts came out, but I got his voice mail. I told him I was not happy as now my contracts were not enough to work for me and asked him to call me back, but the never did. 3 days later I called back, got his voicemail again, and cancelled the contracts, and asked him again to call me regarding the paperwork and my deposit. He still has not called me back. :confused3 )

Anyway, how do I go about getting my deposit back? What do I do with the mountain of paperwork I was sent? Does anyone know? :confused3

To say that I am unimpressed with DVC would be an understatement!

If you never sent back the signed paperwork then the contracts aren't valid or active yet anyway so you should be OK there. You can call the main number and ask to speak to a manager if you can't get a hold of your guide. The voicemail should be enough to initiate the refund of your deposit but you will probably want to talk to a live person to get specifics.

If you still have the paperwork there should be a phone number on the first page or so for the "problem resolution" folks (sorry can't remember the official name they go by). If I remember correctly it was a separate page that said something like "for any problems or questions before signing please call...."
 
We got out of our BLT contract also. They told us we had to fax a letter to get our deposit back. I said I didn't have access to a fax, but had email (email is just so much more convenient for me) they allowed me to send the cancellation letter through email instead after much back and forth discussion.

Call the sales number and ask to speak to a Manager.
 

I too cancelled our BLT add on - I had sent back signed paperwork though - if you haven't signed then you aren't even in the 10 day grace period. My guide put the initial cancel on it, and I followed up with a fax. They called yesterday (my 10th day) and confirmed everything and said the deposit should credit back to me no later than 20 days.
 
I wish we could cancel. If DVC continues to be able to change the points 20% a year not sure if we are going to keep it. I am so glad I convinced DH to add another 55 points at BLT for a total of 230. I had wanted the 55 points for a cushion. Did not realize I would needed so soon. pixiedust:

From your description, it's not at all clear what you actually did...or even where you were in the process.

If you had not signed anything, obviously, you didn't buy anything. Then it should be a simple matter of requesting your deposit back.

If you signed a purchase agreement, under Florida law you have ten days from the date you signed to rescind the contract. That recision period is not negotiable; if you are in that period and notify DVC that you've changed your mind, the contract is null and void.

Whereever you are in the process, I would certainly do everything in writing. Especially when you have a non-responsive guide, written documentation could become important.

After this is over, I'd certainly speak to a manager and insist on being assigned a new guide who will take better care of your purchases and other DVC needs in the future.
 
Call and ask for quality assurance, they'll be on top of it in no time!
 
I canceled a 160 point BLT purchase (I had not actually signed the paperwork yet), and I called quality assurance, and they had me write a letter saying that I wished to cancel the purchase and explain why.

BTW, when they say it can take up to 20 days, it's true! I canceled my contract in late Dec. and just got my deposit back this week!

if you purchase ponts now for BLT, don't your point amounts remain the same for aslong as you own?

so,if you had enough points now ... why would it matter how much they increased? OR am i way off base and totally misunderstood our guide?

The contract that you purchased XXX points stay the same. You will have xxx points for 50 years.

What can change is how many points you will need to stay. Lets say that you need 150 points to stay a week starting Dec1 each year at BLT. the 150 works fine now but in a couple of years, DVD changes the point charts and now you need 160 to stay the same week.

ok that is totally not what dh and i understood upon purchase...but, that is a post for a new thread i guess! off to call our guide in the morning! :(

I should add that the total points for the year can't increase, but DVD can change what ever they want, it's in your contract.

If they raise the weekday points, they can lower the weekend points. That's what they did for 2010.

That change make us 30 points short for our usual vacation. :sad2:

You either misunderstood or were led astray by your guide.

The TOTAL number of points for a resort can't change over time. The number of points required for a particular night, in a particular season, for a particular type of villa can change year to year. I believe DVC can "adjust" points costs up to 20% per year...but the TOTAL number of points at that resort can't change. They don't change points costs often, but they did just a couple of weeks ago.

There is a huge difference between the way DVC operates and what we are guaranteed when we buy. In truth, the only things we are guaranteed are:
  1. We will be able to use our points at our home resort, subject to availability. We are currently allowed to book anywhere at 7 months, but that is not set in stone in the POS.
  2. If owners are allowed to book at non-home resorts, home resort owners will always enjoy a one-month booking advantage (currently four months - 11 months at our home, 7 months elsewhere).
That's it. Everything else is subject to change, and over the last two years or so, many, many things have changed with the way DVC operates. DVC is very different today from what we bought five years ago.

Thanks to everyone! I called Quality Assurance yesterday afternoon, and they were very nice. It seems my guide had put through the paperwork to cancel, and to request a refund of my deposit. (I should have the refund in 20 days or less.) He just didn't call me to tell me that he had done it. Quality Assurance was NOT happy that he did not return my call, and said they would be contacting him shortly after they got off the phone with me. ;)

So, for the time being I will sit tight with my 160 AKV points and watch how things play out. I probably didn't need to be spending another $10k + on DVC in this economy anyway. :)

I was just thinking today - after the initial disappointment - I am kind of glad they did the point thing now - which ticked me off -while I was in the 10 day cancellation period - and that we didn't add $16000 of debt in this economy. Our original 2 DVC purchases are paid off - we don't need more debt! It would be interesting to know just how many people have cancelled in the last week after the rush to add on by the 15th...
