Can one spouse purchase a DVC?

My husband does not vacation (except on the RAREST of occasions). He also dislikes anything Disney related, but understands that myself & DD love Disney. Can one half of a married couple purchase a DVC in their own name or if you are married is it required to be joint ownership.

Or possibly via a resale thru Timeshare Store? Ownership regulations the same there?
 
I just purchased at BCV. I am divorced, but they did not even ask about a wife. I just went in for the tour with my DD and bought that day. I am not sure they can legally require both spouses to purchase.

I think that you could buy on your own. But if you are using financing you will probably only be able to claim your income and will have to claim all debt that has your name on it. They probably wouldn't give me a loan with just my income listed and my house and cars listed as debts.
 
Yes you can, we've done it though it wasn't intentional. Purchased resale and they forgot to put my wife on the contract. Since it would have cost us to fix it, we just let it go. We put her on as an associate member where you get everything but the card and being on the deed. This wasn't good enough for her so we just went out and bought another contract a couple of years later and made sure she was on the deed.
 

I notice that you live in WI, and I know that WI has some interesting laws abut married couples and buying real estate and getting credit cards, community property and such. I'd contact DVC and ask them.
 
I think you can, though I am not sure about your state laws. I purchased my first contract and several add-ons in my name only. My husband doesn't vacation either, so I purchased alone. I did pay cash instead of financing though. I don't know if that would make a difference.
 
hi, we are dvc members and when we purchased i was not working and i did not have any credit and we just put everything in my hubbies name, then when we purchased our add-on we were going to put my name on this one and they told us that it had to be the same as the first one, but we did not care just as long as we got more points.:teeth:

Why not just purchase it together if there is any doubt on credit or financing, just because he doesn't want to go doesn't mean he can't be on the deed?
 
You might want to consider if joint ownership is beneficial for financial planning (estate, asset protection) purposes. Ask your lawyer.
 
I'm willing to bet anything that Disney will let you do just about anything to get your money in their hands and DVC points in yours!

When we/I purchased, DBF put the down payment on his credit card, but he didn't want to be on the contract (his reasoning was that he's 54 and is convinced he won't be around in 40 years, but he's not going anywhere without me!:p)

Anyhow, Disney allowed us to do that, but I had to sign a document stating that if I should change my mind within the alloted time period that the down payment would go back to him!

According to our guide apparently they had run into problems with this previously, but he said usually it was parents putting down payments down for their children and then not getting their money back when their children decided NOT to go through with the purchase.

They actually have a FORM already for that and all they had to do was insert our names!

But I am certain they have considered all situations and have had their lawyers check everything out to allow you to purchase under almost ANY circumstances!
 
My DVC contracts are in just my name, although I listed my husband's income. I insisted that if I was making the payments, then I wanted my name on the contracts first. So they listed me, and forgot my husband's name completely!Since the surviving spouse gets all assets when the partner dies, at least in my state, he still would get the DVC membership, so we didn't think it was any big deal.

Wish I had asked about leaving DH off the contract. Then I wouldn't need his approval each time I want to add-on!

Just buy another separate contract of 150 points or more and you won't need his approval then either.
 
My hubby hates Disney also, so I purchased a contract by myself and listed his income on the financing application. No problems!
 
When we purchased last year it is in my name only. I don't remember if my husband's income was considered also or not. We had to do this due to credit problems my husband had during his first marriage.
 
The only state laws that should come into play in this situation would be Florida or South Carolina (if buying HH) since real property laws are governed by the state the property is located and not the state in which you live, unless of course they are the same state.
 
I agree with the others. Get the contract in your name if you are going to pay for it. A financial side must be considered too, if you get divorced there is no transferring of deeds etc, Could happen!!. In community property states such as mine, NJ, your husband will get title when you die
