Can I still get 2009 points?

The new POS was posted today on the Member website in downloadable pdf format. Most things were not changed at all, but there are some changes. Some of the changes are for clarification purposes and some are significant changes (like allowing individuals to be "Associate Members" on a maximum of for contracts - among other restrictions).

I think providing the POS in this form is a great move instead of providing it by request except with a new purchase.

I saw the change in language regarding first year banking only as protecting MS from being in violation of the rules when they do allow it. However, it still looks to be optional at DVCMC's discretion. Before counting on it, I would still like to see a written policy that at this current time, they are allowing late point banking in the first year. -- Suzanne

That was essentially my point above, the old rule covered the action and DVC was in violation of it. The new rule covers the action and allows the first year banking. As written this would apply to resale and retail purchases as I read it though it's less likely to be needed for resale purchases.

Since resales carry the "original use year" of the original purchaser, my interpretation would be that the language DOES NOT cover that situation (ID cards read "member since" and it goes back to the original member's date of purchase).

I think you could make the argument either way. Read strictly I think the best interpretation would be that it did apply to both resale and retail during the first year of their use though I'm sure the actual intent is for retail. As I noted, I doubt it will come up very often for resale but it will eventually.
 

That may or may not be the case. Our use year is June. Our name came up on an add on list through Disney in April one year. Our closing took place in May and we were NOT allowed to bank the points into our next use year. I complained and they said tough luck, too bad. We did end up renting the points at a bargain basement price and the person we rented them to WAS allowed to bank them--boy did that steam me to no end. The latter loophole has been closed as far as I know, but there is no guarantee you will be able to bank points purchased late in your use year, even though many people report that they have been able to do so.

Something doesn't sound right here. If your Use Year is June, you can still bank them regardless when they were purchased. You haven't even hit your 4 month window yet. I purchased 130 points in April and another 130 Points in June. Both with March Use Years and I banked them ALL so now I have 520 BLT Points for 2010.

Yes 'some' dues will be assessed. Not many though.

We purchased 130 points BLT points in April and another 130 in June. Both March Use Year. When the dues for 2009 came calling, our 1st set of 130 points had higher overall dues due than the 130 June. So even though the resort didn't open till August, it seems the owner takes over the dues requirement upon purchase date, not opening date. While we didn't have to start paying until opening, our fees were prorated back to whenever the points were originally purchased.

Those June UY points added on were from June Use Year allotment about to expire; the poster purchased and closed on these points in May just prior to the start of their next June Use Year, so that is what made these points BEYOND the banking deadline of January 31st. It is unfortunate that when DoctorP purchased that MS did not allow the points to be banked but as you can see from reading this thread and particularly from what Webmaster Doc quotes the ability to bank beyond deadline may be extended by DVCMC; it's not a given.

Your case is different, ~when~ you purchased your points
you were still within the banking window of those allotments
of points (because you bought in April & June) :

Your Use Year is March; March 2009 UY runs from 3/1/2009 - 2/28/2010

so your purchase in April and June of 2009 meant those

points from 2009 Use Year allotment came into your account before

your banking deadline of Oct 31 2009 for your March 2009 UY.

When you purchase a new contract directly from Disney, the dues in the year of purchase will be pro-rated starting from the later of: your purchase date, the start of your initial Use Year and the occupancy date of the Unit you purchased. Assuming your initial Use Year is March 2009 then for both of your contracts the occupancy date will be the date used to determine your dues for 2009. As I recall, the occupancy date for all BLT units is the same since the entire building opened at once and that 9/1/2009 was the original date. The resort actually opened earlier than planned (8/4/2009?). Is the occupancy date on your contracts the same or does one specify 9/1/2009 and the other 8/4/2009?

If your occupancy date is 9/1/2009, you would owe 122 days worth of dues for 2009. (122 / 365) * $3.67 *130 points = $159.47 (approximately -- DVC dues go out to four decimal places so the actual number is probably a few cents higher).

If your occupancy date is 8/4/2009, you would owe 148 days worth of dues for 2009: (148 / 365) * $3.67 * 130 points = $193.45

How much did they actually charge you for each contract? If it is more than the numbers indicated above, you should call Member Accounting and ask for an explanation.
