Anyone else think this newest lawsuit will see the end of the nacho cheese at the two counter service places in the MK?

Ugh! I really hope not! :confused3 I am SO insanely annoyed about this lawsuit. In my opinion, these parents should be sued for being so stupid. Who in their right mind just gives a 4 year old a plate of food without making sure that it is cool enough for him/her in the first place?! Unbelievable!

I bet they will still serve it....practically cold.

This is ridiculous. That nacho cheese begins to cool the second it is removed from the heated serving container. We had some in January and it was nearly totally congealed in just a few minutes. I noticed this family traveled in March. Outside temps couldn't have been very high; the cheese would have cooled quickly.

And yes, IMHO, it is the parents who are responsible for ensuring their toddler's food is not too hot, or he isn't playing with a knife, or he doesn't put something poisonous in his mouth.

if i'm not mistaken... there's a warning on it that says hot. i could have made this up in my head... but i'm pretty sure.

As a mother of a four year old I must ask this question, "What kind of idiots are this kids parent's to give hot food to a child without properly cooling it off first"????. In my opinion this is another classic example of typical greed. Lets sue for pain and emotional suffering and try to get lots of money from a major corporation. My Advice to those parent's, Get a good job and earn your money instead of trying to reap it from someone else.

I agree. Someone should call DCF and report the parent's for neglect.

Not unless McDonald's also stops selling coffee. Remember that lawsuit? Similar premise: I bought something hot and burned myself so it's your fault for selling me something hot.

Last year on our way home from WDW, we stopped at an airport Burger King. We didn't have a whole lot of time to eat before our flight and I ordered a fish sandwich. They must have just taken it out of the fryer and there was a pocket of hot oil when I took my first bite. It just stuck to the roof of my mouth and I was so flabbergasted that I couldn't react and get something cool to drink to wash it down. I ended up with a huge blister....literally peeled a thin layer of skin off a few minutes later. It hurt like bloody hell. We were in such a hurry that I didn't even have time to stop back at the counter to complain. And I sure as heck didn't think of suing them. But I have been afraid to order a fish sandwich from anywhere ever since.

That all being said, if it had been one of my kids rather than me, I'd have been very upset and I'm sure their reaction would have been more severe...but I still don't think I'd have considered a lawsuit. I think all of us at one time or another have taken a bite of something and burned our mouth. I've read that the photos of the child burned by the nacho cheese show a pretty serious burn on the upper lip. I'm sure the parents were distraught as I know I would be. Gotta wonder how hot that cheese sauce could have been.

That lawsuit is what made mcdonalds start putting the warning on their hot beverages. The issue for them wasn't that the coffee was hot but that mcdonalds (and many fast food places) SUPER HEATED their hot beverages which made the coffee not just hot but a lot hotter than coffee would normally be - and they didn't tell anyone that they were doing it.

The nacho cheese containers do have a warning label on the machine telling them you that the cheese is hot. And with how quickly it congeals I don't believe they heat it to extreme temperatures.

Plus, food has to be heated to certian temps in order to be served without causing foodborne illness. Granted, its cheese and not meat but there are specific guidelines restaurants have to follow and staff with licenses in that kind of knowledge.

I can't imagine cheese being that hot to cause the burns shown in that photo. Parents are responsible for their children (or should be) and shouldn't blame someone else for their lack of attention.

I swear, some people are just too stupid to live. Hmm, nachos w/ hot cheese on it??? Maybe i should make sure it's not too hot for little johnny to have it. I'm sorry that the child got hurt; but parents need to suppervise what their kid eats and is not enough to harm them.

I guess I don't understand what happened?? I thought when we went to Cosmic Rays that you got the nacho cheese self serve at the condiment bar?? Isn't that the case. I seem to remember it was in a big vat and you scooped it out with a ladle? Or am I remembering wrong?

So it seems to me that Disney didn't serve them anything? Didn't the PARENTS serve the hot nacho cheese to the kid?

Does anyone know more details about what exactly happened?

Maggie
