Ana & Elsa Coronation....is this legal?

My husband is an IP attorney and had a client who wanted to offer princess parties in the midwest. He instructed them to stay away from using Disney's character names that aren't straight from the old fairytales. So (at the time) Sleeping Beauty, Cinderella, Beauty, and Snow White were OK, but under no circumstances should Aurora or Belle be used. Now, the princesses clearly dressed in outfits that look like they were straight from the Disney movies, but without using the actual images or names, there is no infringement. Once you get into using what Disney created (names or images that came from Disney) you're on shaky ground.

It's up to Disney to enforce their own IP rights. I would expect that if Disney caught wind of that advert (especially since the place of business is located in Florida) they'd shut it down quick. The fair use doctrine (what they're trying to invoke with "no infringement intended") doesn't apply when you're using someone else's intellectual property to make money. OP, maybe forward the website's URL to Disney. Maybe they'll give you some free FPs or a Mickey bar for helping them track down IP theives. :P
 
I'm sure Disney will handle this. Nobody is better at limiting access to Frozen characters and merchandise than they are. :)
 

Wow. Now that I look at their site, those people are ballsy. They even have a picture of the characters at their M&G at Akershus on one of their pages.
 
I saw a girl on instagram who dresses up as Anna and her friend dresses up at Elsa and they did a 'meet and greet' at a Barnes & Noble and she had pictures. People were literally lined up out of the store to meet these two fangirls in cosplay costumes. I cannot imagine that a company like Barnes and Noble wouldn't be smarter than to book something like that.
 
Slightly :offtopic: but those fake disney characters freak me out a lil bit. I was at a kids party a while ago and there was someone dressed up as "everybody's favorite mouse" and a "silly ole bear" -- and they were such ratty, freaky costumes. Everyone was trying to get me to take a picture since they know I'm a Disney nut and I was like umm no, I'll pass.
 
We have a rip off company in NE Ohio that has a SoPHia the first face character. It makes me so angry! Sofia is a CHILD not an adult! The belle? Has summer teeth! Gross! And a coworker just took her daughter to disney for the first time and said she wasn't going to bring her to meet any characters since she already had met them all at those rip off parties. My eyes had to be like saucers. Ew.

OMG, I know! I friend of mine had a fake Minnie Mouse at her kid's party and thought I'd be impressed because I'm into Disney. It was sooo weird looking. And it talked :confused3
 
Can I sue them for the grammar on their website?? Please?

Our local Simon Mall is having an 'ICE Princess' party tomorrow - they have advertised And they show a picture of then Elsa look alike playing thei r "Ice Princess".....I think it's totally legit as long as they don't use their disney names...
 
The local high school was advertising a princess tea party fundraiser where kids could meet princesses. And there were actual copyrighted Disney ones too - Jasmine, Mulan, Belle, Anna and Elsa. I thought the same thing, ballsy.
 
I know that what they are doing violates all kinds of copyright laws; however, the only positive I can see it that some of these girls/boys may never have the opportunity to go to Disney to see the real princesses.

The ones in Times Square are the absolute worst!!!

Chances of seeing them if they do go aren't great.

Mulan isn't Disney property- the story, with that name, existed for a very long time.

Our local party companies call the others "Arabian Princess" "Beauty" and "Ice Princess" and "Ice Queen".

Shockingly, they look JUST like Disney's!

For less money, you can just get a generic princess. (It's easier for the company to find girls to play them, I guess.) My friends with little kids tell me their kids are just excited to play songs and games with a "real princess" as they are a Disney princess. For some of them- they know Disney is make believe, but if it isn't one of the cartoon princesses, it's real!
 
Yeah, that's going to get shut down. Disney takes this stuff VERY seriously
I wouldn't be so quick to say that. We have a local company that has been doing princess events under the Disney princess names for 15+ years. They work with many major businesses and advertise all over the place. Our Disney store even gives you their name if you are party planning. They have the same disclaimer and are not affiliated or anything with Disney. It's a local mom who hires college girls to dress up and entertain the little girls.
