13 Year old gir declared brain dead has now officially died

Although the hospital does agree that she is brain dead, their arguments were that they couldn't be forced to pull the plug because she was never "pronounced dead". And of course the reason why she hasn't been pronounced dead is because the hospital refuses to have any of its doctors do it. Nice circular logic there. I'm wondering why there wasn't anything like the Jahi McMath case where a judge appointed an outside doctor to make a diagnosis and allow that doctor to pronounce death based on those findings.
 
Read the judgment signed by the court. The judge never addressed the constitutional challenges because he ruled the law does not apply to a deceased patient.

the DA's function is to represent county entities in civil suits.

I wasn't so sure whether or not it was a private or public hospital. However, I'm from an area where DA's offices are only concerned with prosecutions and prosecutorial investigations, while county attorneys/counsels are charged with protecting the country's legal interests.

Ditto. In NY the district attorney's function is limited to criminal prosecution. A county hospital would be defended by tge county attorney's office.

Confuses the heck out of me sometimes. I'd never heard of a DA's office that was involved in defending county agencies in civil matters. I have heard of Arizona, where the "County Attorney" is also the prosecutor.

Absolutely should have been expected. We're talking a mother with lack of oxygen for about an hour. The fetus probably suffered the equivalent fate for a fetus. And once brain death sets in, her organs can't survive beyond maybe a week. The kidneys and liver would fail and the bloodstream will be a toxic waste dump. They were probably keeping the blood pressure up with lots of drugs. As with Jahi McMath they probably used a lot of blankets to keep the body warm.

This is just wrong.
 
Taking her off life support is the right thing to do but I can't help but feel a little guilty for being happy the judge made this decision. I know she is already dead but it still feels kind of morbid to be happy someone is being allowed to "die", for lack of a better term.

Even as someone with no connection to the patient these cases are so emotionally complicated, I can't imagine what the friends and families are going through. Hopefully this will allow them to find some peace and to be able to grieve their loss.

The family is finally getting what they've wanted. They know she's dead. I read an article in which the husband talked about how it's so obvious she is dead, even down to an odor. It seems it had been so hard on them to have to watch her deteriorate and not be able to lay her to rest.

I hope they sue the crap out of anyone involved in these shenanigans. What was done to this woman's body and her family emotionally was deplorable.

FINALLY!! Poor husband and parents having to go through all this on top of losing their wife/daughter. :sad2:

If that is the case, those abnormalities are probably not related to the cardiopulmonary arrest, as those organs develop around the 4 - 6 week range, way before her event at 12 weeks.

So, if I understand you correctly, this was not a viable pregnancy from the beginning?

That is a distinct possibility.

I should add the typical disclaimer: I am not involved in this case as a treating physician, and until specific tests can be run on both the mom and the fetus, we may not get a definitive answer.

I would want them to sue as well, but more importantly, I would want them to fight to get this silly law removed from ALL states. Dead, alive, sorry I don't want anyone to override what I wished for in regards to DNR or life saving measures.
